the following information, following the Agency’s response to your previous request, reference
GEMS-46469:
Thank you for your response; it was useful to receive the information you sent.
However, I would also like to receive the full application documents for all of the schools
listed at the link you have quoted in your response

Your request has been considered under the Official Information Act 1982 (the Act).

The Agency will update our website as new charter schools are announced, so we have
interpreted that your current request relates to the above-listed schools only.
The Agency is in the process of publishing the applications for the above-listed charter schools on
our website. Therefore, I am refusing your request under section 18(d) of the Act, as the
information is publicly available. A copy of each application is available within each charter school’s
listing on the Charter School Agency website here:

We have previously provided you with applications for three charter schools, as part of 46469:
• Altum Academy
• Encompass Education Hub (Autism New Zealand)
• New Zealand Performance Academy Aotearoa
As set out in the
Document Table below, some information has been withheld from the published
applications under the following sections of the Act:
• 9(2)(a), to protect the privacy of natural persons.
• 9(2)(ba)(i), to protect information which is subject to an obligation of confidence or which
any person has been or could be compelled to provide under the authority of any
enactment, where the making available of the information would be likely to prejudice the
supply of similar information, or information from the same source, and it is in the public
interest that such information should continue to be supplied.
• 9(2)(b)(ii), to protect information where the making available of the information would be
likely unreasonably to prejudice the commercial position of the person who supplied or who
is the subject of the information.
• 9(2)(k), to prevent the disclosure or use of official information for improper gain or improper
advantage.
As required under section 9(1) of the Act, I have considered the public interest in releasing the
information withheld. I do not consider the public interest considerations favouring the release of
this information are sufficient to outweigh the need to withhold it at this time.
