Dear Toni
Thank you for your Official Information Act (the Act) request received on 18 November
2025 for:
•
Copies of all compliance certificates issued by the compliance certifier and all
associated documents that make up a Fireworks Permit, fire, NOTAM, etc...
issued for pyrotechnic displays held in the Hawkes Bay and Gisborne between the
1st of October 2025 and the 18th of November 2025.
Requested Information Under the Health and Safety at Work (Hazardous Substances) Regulations 2017 (the
Regulations) a Person Conducting a Business or Undertaking (PCBU) has duties when
they direct the carrying out of an outdoor pyrotechnic display including:
1. Obtaining a compliance certificate at least 3 working-days before the display
2. Ensuring that a certified handler with an appropriate certificate of competence is
in control of the pyrotechnics;
3. Notifying WorkSafe (Regulation 9.35(1)) at least 3 working days before the first
firing occurs of: a) the display location, b) the date of the display and c) the time
and number of firings
4. Obtaining prior written agreement from Fire and Emergency New Zealand (FENZ)
Obtaining prior written agreement from the local agency responsible for air safety
in the vicinity of the display, if relevant.
WorkSafe would normally only hold copies of the compliance certificate and Notifications
submitted to WorkSafe under Regulation 9.35(1) of the Regulations. Details of these are
outlined in Tables One and Two below.
For the events held at Anderson Park and the Awapuni Speedway WorkSafe holds
additional information in scope of your request, which is outlined in Table Three.

• 9(2)(a) – to protect the privacy of natural persons
• 9(2)(b)(ii) – to protect information that would be likely to unreasonably prejudice
the commercial position of the person who supplied or who is the subject of the

In making the decision to withhold information under section 9 of the Official Information
Act it has been considered that the public interest in release does not outweigh the
reasons to withhold it.
