I am withholding some information from the above documents under the following sections of
the Act:
- 6(a) as making this information available would be likely to prejudice the security or
defence of New Zealand or the international relations of the Government of
New Zealand;
- 6(c) as making this information available would be likely to prejudice the maintenance
of the law, including the prevention, investigation, and detection of offences, and the
right to a fair trial;
- 9(2)(a) to protect the privacy of natural persons;
- 9(2)(h) to maintain legal professional privilege;
- 9(2)(b)(i ) as making this information available would be likely to unreasonably prejudice
the commercial position of the person who supplied or who is the subject of the
information;
- 9(2)(f)(iv) to maintain the constitutional conventions for the time being which protect the
confidentiality of advice tendered by Ministers of the Crown and officials.
Where information is withheld under section 9 of the Act, I do not consider that the withholding
of this information is outweighed by public interest considerations in making the information
available.
You have the right, under section 28(3) of the Act, to ask the Ombudsman to review any

1 Documents 1-13 incorrectly used the 2024/25 naming format as a result of an administrative error, despite
being produced in 2025/26 FY. The administrative error was amended for reports from week of 12 November
2025 (document 14).
