Dear Andrew
Thank you for your Official Information Act request received on 14 November 2025. You
requested:
•
This is a new request for information under the Official Information Act, relating
to the "Notice of Approval" for application VAP2303 dated 26 March 2024.
In that Notice of Approval VAP2303, WorkSafe applied several conditions. My
request concerns Condition 4f, which states that the New Zealand specific
installation and instruction manual must:
"f. if followed, will ensure that the installation of the vapouriser is safe and
compliant with New Zealand law."
In your letter of 14 November 2025, you stated that WorkSafe "did not undertake
any assessments against AS/NZS 60079.14".
Given that AS/NZS 60079.14 and the Electricity (Safety) Regulations 2010 are
part of New Zealand law, I request the following information:
o
All documents, technical assessments, correspondence, and any other
information that WorkSafe used to justify and conclude that the
installation manual for VAP2303, if followed, would ensure the installation
is "compliant with New Zealand law".
o
All information WorkSafe holds that discusses or confirms whether
Condition 4f of the VAP2303 approval supersedes or overrides the
installer's legal obligations under standards such as AS/NZS 60079.14 and
the Electricity (Safety) Regulations 2010.
This request is for the information WorkSafe used to validate the compliance
claim made in Condition 4f of its own approval notice.
Requested Information
1. All documents, technical assessments, correspondence, and any other information
WorkSafe used to justify and conclude that the installation manual for VAP2303,
if followed, would ensure the installation is "compliant with New Zealand law".
o While WorkSafe received documentation from the manufacturer providing
evidence of compliance with regulation 17.53(3) of the HS Regulations,
these documents are commercially sensitive, for this reason, this part of
your request will be refused in full under
section 9(2)(b)(i) of the Official
Information Act.
2. All information WorkSafe holds that discusses or confirms whether Condition 4(f)
of the VAP2303 approval supersedes or overrides the installer’s legal obligations
under standards such as AS/NZS 60079.14 and the Electricity (Safety)
Regulations 2010.
o This information does not exist, for this reason, this part of your request is
refused in full under section 18(e) of the Official Information Act.
