Subject: Energy Safety Standards Update - standards tables and further information

Thank you so much for your patience while we have been updating the standards tables to 31
December 2023. Unfortunately, we significantly miscalculated how much time it would take for
us to go through al the standards and determine where it is appropriate to adopt more recent
versions than what was consulted on (if they exist).
I have attached two documents to this email:
1) Excel document – this has been updated with the most appropriate standards as of 31
December 2023.
2) Word document – this provides information about substantive changes we are
recommending compared with the 2021 consultation and relate to matters such as:
• proposals to adopt newer versions of standards but there are additional
compliance costs for industry that have not been consulted on.
• variations to the citation of standards to incorporate New Zealand specific
safety modifications or correct errors that have not yet been fixed by way of
amendment.
In the Excel document, I have highlighted in yellow the rows where we are proposing something
different to what was consulted on to assist you in identifying the relevant standards. Note that
only changes that we consider to be substantial are discussed in the Word document. For the
Electricity (Safety) Regulations, I have also highlighted some rows in pink as these are
standards that relate to electricity harmonics, which the Electricity Authority is currently
consulting on. Further explanation of the harmonics work is set out in the Word document.
Something else we would like to discuss with you is a recent email we received from MBIE’s
Trade and International team about when to contact them as Technical Barriers to Trade
Enquiry Point where agencies are making changes to regulations relating to goods. Michael and

Hayden were on the distribution list, but I have attached a copy of the email just in case it
wasn’t shared with you. I don’t think any of the proposed changes to standards or conformance
bodies would be inconsistent with New Zealand’s international trade obligations but perhaps
we should discuss this further?

Subject: MBIE Comments/Questions on WS proposed changes to and modifications of standards
citations.
Hi Paul,
Attached is the document Lydia provided us on June 25 titled
Further information about changes to
standards included in Energy Safety Standards Update, and a spreadsheet providing MBIE views on
and questions about these changes.
It’s a very rough sheet, so my simplification of WorkSafe descriptions may not be perfect, but
hopefully it’s easy enough to follow. My main point would be that I think we are comfortable with
the vast majority of these changes without the need for further consultation, although in some cases
this is pending a little further detail or clarification it would be great to get from you guys. That then
leaves us with only a couple that may need some targeted stakeholder engagement or further
analysis.
If you could please review this and:
a) Provide responses where questions have been asked or clarification/assurance sought about
the detail.
b) Add any other issues to the list you think are worth noting that may not have been in Lydia’s
initial document.
