This response is further to the Ministry of Business, Innovation and Employment’s (MBIE’s) letter of 20
November 2025 notifying you that your requests (DOIA-REQ-0023581 and DOIA-REQ-0023578) had been
partially transferred to WorkSafe New Zealand (WorkSafe). A table indicating what parts of your requests
have been transferred for response from MBIE to WorkSafe is attached to this letter.
On 1 December 2025, the due date for response to the remaining questions of your requests was
extended under section 15A(1)(b) of the Official Information Act 1982 (the Act) to 19 December 2025.
The reason for the extension was that consultations necessary to make a decision on the request were
such that a proper response could not be made within the original time limit.
The information is being provided on the basis this is in relation to the regulatory change to allow a fuse,
independent circuit breaker or switch within a protective earth neutral (PEN) conductor, and not the
Standard AS/NZS 3000:2018 as a whole.

further search of our systems, all documents are in fact held solely by WorkSafe. Therefore, I am refusing
this part of your request under section 18(e) of the Act, as the documentation al eged to contain the
information requested does not exist or, despite reasonable efforts to locate it, cannot be found.

I am withholding in full
draft documents 1a, 1b and 2a under section 9(2)(f)(iv) of the Act, to maintain the
constitutional conventions for the time being which protect the confidentiality of advice tendered by
Ministers of the Crown and officials. I do note that
final versions of these documents have been publicly
released, as noted in the table above.
I do not consider that the withholding of information under section 9 of the Act is outweighed by public
interest considerations in making the information available.

WorkSafe will work with Standards New Zealand to insert these changes into the substantive standard
through the normal standards amendment process, should it be suitable for inclusion.

Additionally, Standards New Zealand can include a reference note at the beginning of a standard to
indicate relevant modifications arising from New Zealand regulations, and the relevant agency to seek
clarity from.
This note is only added if an appropriate authority, such as WorkSafe, requests it. You may wish to
contact WorkSafe directly to confirm whether it intends to request these modifications for this standard.
2.2 Question 2 of DOIA-REQ-0023578:
IANZ/NATA and equivalent accredited test houses are required to undertake product testing to the
product Standards as written.
