The WorkSafe Board meeting agenda and minutes for December 9, 2024
(Meeting 111) list the following items:
Item 4.3.1 (Appendix): Serene Heater Review Report The minutes from this
meeting state the Board "NOTED and ENDORSED" the recommendations and
"endorsed management’s response."
I formally request copies of the following documents:
The "Serene Heater Review Report," referenced as Appendix 4.3.1 for the
December 9, 2024 Board meeting.
The "management response" to the review, which was endorsed by the Board at
the December 9, 2024 meeting.
Any reports, updates, or papers on the "review into Serene heaters"
On 26 November 2025, the time limit for deciding on your request was extended due to
the consultations that were necessary.

The documents in the table above are being withheld in full under section 9(2)(h) of the
Official Information Act:
to maintain legal professional privilege.
The External review undertaken by Barrister Honor Lanham has previously been
requested under the Official Information Act. Recently, the Chief Ombudsman advised
WorkSafe of his final opinion that WorkSafe was entitled to refuse the request on the
basis that withholding the information was necessary to maintain legal professional
privilege.
In making the decision to withhold information under section 9 of the Official Information
Act it has been considered that the public interest in release does not outweigh the
reasons to withhold it.
