Request for information 2025-391
I refer to your request for information dated 12 November 2025, which was received by Greater
Wellington Regional Council (Greater Wellington) on 12 November 2025. You have requested
the following:
“I have checked the requested file and found that the full reference includes a
zero prior to the 1 on 10043. In other words, on the system the reference is WGN
010043. I would suggest that this is not an ideal number format for a file as the
zero may often be removed by software.
I would also question the failure to locate the requested file given that it would
have come up in any search of the property information for 1044 Coast Road in
your system.
Please provide a full copy of the requested consent.”
Greater Wellington’s response follows:
On 25 November 2025, Greater Wellington advised on how we had interpreted this request for
the full copy of consent WGN010043. We indicated that we identified the following documents
that were considered to be the only documents within scope of the request:
1. Original consent and associated decision - October 2000
2. Variation to consent and associated decision - April 2001
3. Variation to consent and associated decision - February 2002
4. Variation to consent and associated decision - June 2006

On 26 November 2025, you advised the following in response:
“For this consent, the original consents and variations are required.
I do not need any other documents prior to 2020. After that date, I require any
correspondence and investigations relating to this consent.”
There are no correspondence and investigations relating to this consent after 2020. The reason
for this is that this consent expired on 30 October 2015.
The original consent and subsequent variations to the consent are attached with this response.
Please note that we have withheld the names of persons, contact information and personal
addresses related to the consent file under section 7(2)(a) of the Act to protect the privacy of
natural persons, including that of deceased natural persons. When withholding information
under section 7 of the Act we are required to consider the public interest in the information. In
this instance we do not believe that the public interest outweighs our reasons for withholding
the information outlined above.
Comments on your correspondence
We have also considered the comments in your correspondence above and note that they do
not constitute a request for official information under the
Local Government Official
Information and Meetings Act 1982 (the Act), as they do not seek access to specific
information held by Greater Wellington. While we are not required to respond under the Act, we
are happy to address your surrounding comments in good faith.
Previous attempts to clarify
On 16 October 2025, Greater Wellington attempted to clarify the scope of your request,
reference 2025-355, along with several other requests received at a similar time. We advised
that it would be best to meet with the representatives processing your official information
requests so you could clarify the number referenced in your request, as this digit did not exist
in our system, as well as to clarify the scope of your other requests. No response was received
by you, the requestor, and therefore Greater Wellington refused this request (2025-355).
Reason for previous refusal (2025-355)
In our response letter, File Ref: OIAPR-1274023063-42432, which covered requests 2025-330,
2025-345, 2025-346, 2025-354, 2025-355, 2025-356, & 2025-357, we explained why the
consent information was not provided. Specifically:
“You requested a copy of resource consent WGN 10043. Further clarification was
sought on 23 October 2025 as our resource consents always contain a six-digit
number. No response was received hence we have refused your request under
section 17(e) of the Act on the basis that the document(s) alleged to contain the
information requested does not exist, or despite reasonable efforts to locate it,
cannot be found”.

Greater Wellington refused this part of your request under section 17(e) of the Act because,
despite reasonable efforts, we were unable to locate the consent ID referenced in your request
as it did not include the required six digits. This consent, now clarified as WGN010043, has also
been confirmed as not being attached to the property at 1044 Coast Road. Consequently, at the
time of processing your previous request, it could not be found using the property address (1044
Coast Road) or other search parameters mentioned (i.e., Wainuiomata, Cleanfill, Sediment
Discharges, etc.), as it was not associated with this property.
If you have any concerns with the decision(s) referred to in this letter, you have the right to
request an investigation and review by the Ombudsman under section 27(3) of the Local
Government Official Information and Meetings Act 1987.
Please note that it is our policy to proactively release our responses to official information
requests where appropriate. Our response to your request will be published shortly on Greater
Wellington’s website with your personal information removed.
