Appendix 3: In-scope gases that are not covered by the ETS
1. As per the Declaration of Priority Products Notice 2020, HFCs, CFCs and HCFCs are all
within scope for a regulated product stewardship scheme.
2. While HFCs are covered by the ETS, CFCs and HCFCs are not. These legacy gases are
ozone depleting substances that can also have very high global warming potentials.
3. CFCs and HCFCs are not covered by the ETS because these gases are not within
scope of New Zealand’s international climate commitments under the Paris Agreement.
4. Under the Montreal Protocol, there has been a global effort to phase out the production
of CFCs and HCFCs. New Zealand stopped importing most CFCs in 1996 and phased
out imports of most HCFCs in 2015.
5. Refrigeration equipment can have a lifespan of 30 years or longer. Consequently, there
is still a notable bank of HCFCs and a smaller bank of CFCs still in use in New Zealand.
There are currently no Government policies in place to economically incentivise the
destruction of these legacy gases.
