Official Information Act request: Covid-19 Response (Vaccinations) Legislation Act
Thank you for your email of 20 September 2025 requesting, under the Official Information
Act 1982 (the Act), information regarding the Covid-19 Response (Vaccinations) Legislation
Act. Specifically, you requested:
On a document addressed to the Hon David Parker, Attorney-General titled Legal
Advice LPA 01 01 24 on the 23rd of November 2021, your ministry stated the
following:
2. We have not yet received a final version of the Bil . This advice has been prepared
in relation to the latest version of the Bil (PCO 24238/9.5). This advice has been
prepared in an extremely short timeframe due to the late receipt of the Bil that was
not in compliance with Cabinet Office Guidance. We wil provide you with further
advice if the final version includes amendments that affect the conclusions in this
advice.
Please provide an explanation as to why or what was not in compliance with the
Cabinet Office Guidance.
The Cabinet Of ice Guidance (CabGuide) provides practical information and advice for
public servants and Ministers' offices on the procedures and operation of the New Zealand
Cabinet. The CabGuide states:
If a final version of a government bil is not with Ministry of Justice/Crown Law at least
two weeks in advance of the LEG meeting, the Minister sponsoring the bil should
defer submission of the bil to LEG.
LEG refers to the Cabinet Legislation Committee, which considers bills for introduction
before they are referred to Cabinet. You can read more about this here:

In the instance that you are referring to, the final version of the Bil was not provided within
the two-week timeframe, as sometimes happens when a bil needs to be progressed
urgently. When advice is not based on the final version of a bil , the advice may be updated if
the bil changes in a way that affects the conclusions of the advice. This was not required in
this case.
