Tēnā koe,
Official Information request and response
Thank you for your request under the Official Information Act (“OIA”) dated 16 September 2025, which
was transferred to NZ On Air on 22 September 2025.
You have requested:
“I note over the last year four CEOs have had their terms extended, without any public information
about the process undertaken, and in almost all cases without any public notification of the
extensions. This includes the CEOs of: Broadcasting Commission | NZ on Air; Fire and Emergency;
Real Estate Authority; and NZ Qualifications Authority.
I would further like to request a summary from the Boards of these four entities outlining:
-
the process undertaken to determine to reappoint the CEOs;
-
the factors taken into account in making that decision, including whether ongoing
suitability was assessed;
-
whether any external advice, or feedback, was sought to support the decision. This includes,
but is not limited to, whether stakeholder feedback was sought (including from staff); and
-
how, if at all, the reappointment was communicated to staff, stakeholders, and the public.”
Under the NZ On Air Board Charter, the board is responsible for appointing the Chief Executive (CE),
setting the terms of the CE’s employment contract and monitoring the CE’s performance. An annual
formal appraisal of the CE’s performance is required. The timing, format and process for this will be
negotiated and agreed upon between the CE and the Board at the beginning of the monitoring period.
The Board Charter also requires the board to consult the Public Service Commissioner before agreeing
the terms and conditions of the Chief Executive’s employment. The Minister must be consulted if
proposed terms and conditions do not comply with PSC guidelines (Section 117, Crown Entities Act 2004).
In re-appointing the current CE, the Board sought advice from the Public Service Commission and the
Ministry for Culture and Heritage and as part of a regular CE performance review, the Board conducted a
360 review to gain stakeholder and staff feedback. This helped inform the Board’s decision to reappoint.
The current CE details are always published on our website under t
he Our Team section.
