Official Information Act request: Bil of Rights advice regarding COVID-19 vaccination
I refer to your email of 11 September 2025 to the Attorney-General, Hon Judith Collins KC,
requesting under the Official Information Act 1982 (the Act), advice on the Bil of Rights Act
1990 regarding the COVID-19 vaccination.
On 25 September 2025, your request was transferred in full to the Ministry of Justice (the
Ministry), for response under section 14(b)(i) of the Act. Specifically, you requested:
Would you kindly provide the evidence or basis for this statement that vaccination
has been shown to substantially reduce transmission of covid-19? Please supply the
information/evidence relied on in this 23 Nov 2021 AG advice to say 'Vaccination has
been shown to substantially reduce transmission of COVID-19 as well as severity of
symptoms.
On 22 October 2025, the Ministry advised you that the timeframe to respond to your request
was extended, in line with section 15A(1)(b) of the Act, as consultations were necessary to
make a decision on your request which meant that a response could not be made within the
original time limit.
The Ministry produces legal advice to the At orney-General about the rights-consistency of
proposed legislation. The Attorney-General has waived legal professional privilege in respect
of our advice “
Consistency with the New Zealand Bil of Rights Act 1990: COVID-19
(Vaccinations) Legislation Bill” allowing us to publish it on our website here:
Consistency with
the New Zealand Bil of Rights Act 1990: COVID-19 (Vaccinations) Legislation Bil . Legal
professional privilege has not been waived for the background materials relating to the
advice. I am therefore refusing your request under section 9(2)(h) of the Act, to maintain
legal professional privilege.
However, the statement you quote from the above-mentioned legal advice is consistent with
public health advice that was provided to Ministers and Cabinet when they made decisions
on the Bil . This public health advice was contained in briefings, which have been publicly
released on the Department of the Prime Minister and Cabinet’s website, including:

In withholding information under section 9, the Ministry has considered the public interest
and does not consider that it outweighs withholding the information at this time.
