Official information request for Industrial Hemp
I refer to your official information request received by the New Zealand Institute for Public Health
and Forensic Science Limited (‘PHF Science’) dated Tuesday 2 September 2025 for the following
information:
“Under the OIA, I request the following information from 1 January 2020 to 2 September 2025:
Testing/Compliance
Any lab reports, technical data, or assessments on THC testing or compliance for iHemp, provided
to MoH, MPI, or other agencies.
Environmental/Health Assessments
Any documents or advice on environmental or health aspects of iHemp (e.g., phytoremediation,
emissions).
Interagency Communications
Communications with MoH, MPI, MBIE, MfE concerning hemp testing, compliance, or oversight.
Funding/Contracts
Details of any ESR projects, contracts, or MoH-funded work related to hemp.
Please identify which databases/teams were searched and keywords used, per s18(e).”
On 30 September 2025, PHF Science advised via email that the due date for our response would be
for the 8 October 2025. Our response is as follows.
Our Response:
Lab reports, technical data or assessments on THC testing or compliance for iHemp that have
been provided to MoH, MPI, or other agencies are generated at the request of third parties who
have a commercial position as defined under the Official Information Act 1982 (‘OIA’). As a result,
this information is withheld under s9(2)(b) of the OIA which
“protects information that… be likely
unreasonably to prejudice the commercial position of a third party”.
Furthermore, PHF Science wil withhold this information under s2(ba)(i) of the OIA which protects
information which
“is subject to an obligation of confidence … where the making available of the
information would likely prejudice the supply of similar information or the information from the
same source, and it is in the public interest that such information should continue to be supplied.”
PHF Science has commercial contracts in place with these third parties that requires information
to be held on a confidential basis.

PHF Science do not have any documents or advice on the environmental or health aspects of
iHemp.
PHF Science have found two instances of interagency communications with MPI where a meeting
with a MPI staff member around hemp and animal use was discussed. These have been attached
and are label ed:

Please note that al contact details have been withheld under s9(2)(a) of the OIA where
withholding is necessary to
“protect the privacy of natural persons”. The employee who attended
this meeting has confirmed a meeting was held but no notes or further details fol owed on from
this meeting.
PHF Science have found six instances of interagency communications with MOH where iHemp has
been discussed. These have been attached are label ed:

PHF Science do not have any projects or MOH funded work relating to iHemp. Al contracts relating
to iHemp are with third parties and s9(2)(b) and s2(ba)(i) of the OIA apply as per the above
explanation.
As this request is centred around iHemp or industrial hemp, staff in PHF Science’s Forensic team
assisted in searching for the requested information. The keyword “hemp” was used by staff to
search files and emails.
