We have just received the attached agreement for the declaration of the area of land at 1076 Colville Road as Road. I am presuming
that Council will have the necessary gazette action prepared at the applicants cost?
Also I am not sure as to the necessity for a legalisation plan given that the land is already shown as Area A on DP 370526. As it does
not have an area shown on that plan I suspect this will be required but would appreciate confirmation from whoever is preparing the
gazette.
I will confirm with you once the payment has been made by the applicant.

Just had a quick look at the Act. There are two sections relating to acquisition. The first deals with acquisition by agreement and the
second compulsory acquisition of land. The section regarding essential works has been repealed and this only applied to compulsory
acquisition.
I suppose the other option would be to use Section 114 to declare the land road?
