Official Information Request for Joint Witness Statements on setting or reviewing freshwater
targets, limits, criteria or thresholds
I refer to your official information request dated 16 August 2025 for:
1. The most recent joint witness statements (JWS) involving environmental scientists or
technical experts that discuss the setting or reviewing of freshwater targets, limits,
criteria, or thresholds.
2. These statements should relate to your most recent regional plan change where such
matters were addressed.
3. If no JWS exist, confirmation of whether any expert conferencing or similar collaborative
evidence processes took place, and provide the relevant outputs (e.g., conferencing
reports, summary statements, or meeting notes).
A limit setting plan change has not yet progressed through the resource management system in
Southland, therefore there is no collaborative evidence (such as joint witness statements) that
specifically relates to the setting or reviewing of freshwater targets, limits, criteria or thresholds in
terms of the process required by the National Policy Statement for Freshwater Management.
We have, however, recently progressed with the development of the proposed Southand Water
and Land Plan, which is now partially operative. This plan development process was a precursor to
a potential plan change that would consider the setting of limits. You will find the Court
documentation and evidence related to the proposed Southland Water and Land Plan is publicly

The documents that may be most relevant to the theme of your request relate to the
development of ‘Schedule X’, which identifies catchments considered to be degraded for specific
parameters. The documents are available in the table of Council memoranda and court directions
on the webpage above, with the dates set out below:

13 May 2019: Two joint witness statements (‘River Water Quality and Ecology’ and ‘Lakes,
Estuaries and ICOLLs Water Quality and Ecology’) along with two attachments;

4 September 2019: Water quality and ecology (rivers and lakes)
•
17 October 2019: Water quality and ecology (rivers, estuaries and lakes)
•
22 November 2019: Water quality and ecology (rivers, estuaries and lakes)
•
1 August 2022: Water quality;
•
18 May 2023: Ecology and cultural values.
There are also joint witness statements relating to appeals on the plan more broadly. A series of
joint witness statements began with questions identified by the planners for experts of other
disciplines to respond to, before the planners conferenced again. These are in the table within the
date range of 19 November to 10 December 2021, and include some matters relevant to the
development of Schedule X.
The interim decisions from the Environment Court will be a helpful starting point for gaining
further context if you are interested, including references to the evidence relied on. The interim
