Paul has asked me to provide an update on ROW negotiations with the Hawkins Hill Landowners. 
 
As we talked about when we briefed you earlier in the year, in February, we engaged s7(2)(a)
from the Diana Unwin Chair in Restorative Justice at VUW to facilitate an agreement between parties. This followed 
resolutions made by CSC in November 2018 whereby Council agreed to undertake Minor Improvements to the ROW as 
recommended by Tonkin and Taylor and directed Officers to enter into negotiations with ROW holders around 
contributions to this. Council’s contribution to this is 1.23M over 20 years and the contribution being sought from 
landowners is 11K per lot over 20 years or $560 per lot per year. CSC also resolved a number of other things including 
re-instating the electronic gate at the Wind Turbine which happened in December 2019, putting in place a speed limit 
and closing access through Wrights Hill both of which are still to happen. Prior to this there had been several 
unsuccessful attempts to reach agreement between Council and landowners including an MOU that was developed in 
2017 but rejected by the majority of landowners. Over the years the ROW has continued to deteriorate, exacerbated by 
ongoing subdivision which has put additional pressure on the ROW, and there is an need for improvement and 
maintenance works to progress to ensure it is safe for all users. 
 
s7(2)(a)
met with landowners in February and recommended a ‘one text’ mediation process 
where all parties, including WCC, were provided the opportunity to review and critique drafts of a 
framework until agreement was reached, or it was determined agreement could not be reached. Four 
iterations of the agreement were provided to parties for review and most landowners engaged in this 
process. This process was put on hold during the lockdown due to Paul and I being seconded into response 
roles, but re-commenced in June. The final draft agreement was provided to landowners on the 19th 
October and only one landowner s7(2)(a) esponded that they were prepared to sign up to it. 3 
landowners responded that they were not prepared to sign up due to the proposed clauses around 
formation of a representative working group to liaise between Council and landowners, but they were 
prepared to pay the annual required. 2 landowners did not respond, and the balance, represented by 
s7(2)(a)
 responded that they were not prepared to sign unless the 
agreement included a clause providing an assurance that they could undertake further subdivision of their 
properties. In late November Mike Barnes and I met withs7(2)(a)
to discuss their request and 
explain that we could not agree to this, but could add a clause providing an assurance that the ROW would 
be improved to the standard agreed to by CSC and that further land use and subdivision applications would 
be considered under the relevant planning framework including the District Plan.  
 
On Wednesday I wrote to landowners providing an amended final version of the agreement with 2 new 
clauses added, one in response tos7(2)(a)
request as per above, and one providing an option 
for landowners to opt out of the proposed working group and engage with Council individually. I also let 
them know that we were working with our Roading Team to scope and cost the improvement works 
planned for this summer and would continue to engage with all landowners on this until such time as a 
representative working group was formed. We have had ongoing feedback from landowners around the 
need to address the state of the road and get on for the planned improvement works which are funded

through the 20/21 Annual Plan and we have been keeping them updated around this. There works will be 
tendered in January and we hope to have them started in March. 
 
s7(2)(a)
has responded to our letter to say that the landowners they represent will be meeting early 
in the new year to consider the agreement.s7(2)(a) has responded expressing her displeasure at our 
position. I have not had a response from other landowners including the landowners previously unwilling to 
sign the agreement. 
 
Paul and I are happy to meet and brief you further in February if that would be useful, otherwise let me 
know if you need any more information.
