Request for information
Thank you for your Official Information Act 1982 (OIA) request dated 14 August 2025.
Please accept my apologies for the substantial delay in providing this response. You
requested:
1. The number of, prosecutions under section 7 of the Gangs Act 2024.
Since the Gangs Act 2024 came into effect on 21 November 2024, there have been 875
offences consisting of 742 unique offenders prosecuted under Section 7, as at 30
November 2025.
2. The number of items of gang insignia have been seized, destroyed, and
returned under section 7 of the Gangs Act 2024. Please provide the number of
patches and other insignia items separately.
The Police Register of Property (PROP) is an application that allows officers to record all
non-Police items in Police possession, such as seized (for any reason), surrendered, or
found items. The PROP database records disposal and return actions but does not
indicate whether they relate to specific legislation. Seizures are entered at the time of the
incident and may precede any plea or conviction, and items may be returned for various
reasons. I have therefore provided the number of Gang Insignia items seized for Gangs
Act offending and those subsequently returned or destroyed.
Under section 7 of the Gangs Act 2024, 588 general gang insignia items have been
recorded as seized in PROP since 21 November 2024 up to 20 November 2025. 118
patches and 470 other insignia. 71 of those items were returned and 171 of those items
were disposed of.
These seizures come from a manually audited list that is updated periodically. As cases
progress and auditing continues, the numbers for seizures, disposals, and returns will
continue to change over time.
Items returned to the owner are not generally patches or other insignia but could be for
example a phone case that was covered in insignia, therefore was seized and the phone
was returned.
