lines for the Minister for the tile run today. I know that we had provided some lines already but I think
we need some specific lines for the Minister in relation to the Electoral Commission aspect of it. As
mentioned it will be perhaps a holding line of some kind.

A. I have asked the Ministry of Justice Officials for urgent advice on this issue, which I expect to receive
within the next week.
Q. Do you think the result in Tāmaki Makaurau Māori electorate was unfair, as suggested by Chris Hipkins?
It would not be appropriate for me to comment of specific electoral outcomes.
However, I would note that, if anyone has concern about the outcome of the vote the Electoral Act sets out
a formal process by which an election petition can be brought before the High Court. Election petitions must
be brought within 28 days of the official results being declares.
I am heading to SOU now – so  Sheridan, if you are happy with thee lines will you either send them to s9(2)(a)
directly, or ask Ella Pearce (copied in) form my team to do so?

working on the more substantive advice – within the week!

I will call Karl shortly to understand given the media attention what the EC has done to review their
guidelines and processes with regard to selecting appropriate places for booths. The team are also looking at
what we might say with regard to our monitoring and MOU etc that are in place. Jess referred to our BIM
(pg 12) where we note an agreement between us and the Minister on our monitoring appraoch. We have
yet to locate whether we have this and the team are scrolling through the old files.

The Minister of Justice has asked for a revised Letter of Expectations to be developed that will explicitly include an
expectation that the EC review their processes and procedures with regard to voting venues. This LOE is expected to
be sent to the EC within the next few weeks.

Processes have existed for the selection of voting venues and these are approved by the CE.  – I understand they also
consult with political parties etc, on the list of proposed polling places ahead on each election***
The Electoral Commission notes that it has revised its selection processes with regard to voting venues.
They have a draft set of guidelines and will likely present these to their Board in April 2025.
The guidelines would usually be released early next year.
There are some challenges to work through in the guidelines such as if a Principal of a school runs as a candidate
should the school hall not be able to be utilised? School halls are a commonplace for voting venues.
**** This is what they said in their 2023 GE report (page 76)
“When selecting voting places, we consider how best to meet community needs, which is informed by
communities’ feedback. Every voting place is assessed for suitability, and criteria include the convenience of
locations, suitable operating times, shared electorate voting (offering an ordinary vote based on the likely
demand from voters in the surrounding region), political neutrality, disability and mobility access, storage,
and security.. We provide all registered political parties with a list of proposed voting places for consultation

On the ‘monitoring’ role side, would it also be helpful to note for DPMC some of the other activities that the
Ministry undertakes to support the Electoral Commission, particularly in the lead up to a general election
(see attached briefing)?
I am thinking about things like:
the Senior Officials Committee (SOC) , which ensures practical on-the-ground support for the event
as well as shared understanding and assurance.

Our role as monitor entails:
The Ministry meeting regularly with the Electoral Commission and similarly Ministers meet regularly with the
Board and the Chief Executive. He next meeting is 25 March 2025.
A new Board Chair was appointed in late 2024.  – this isn’t directly related to our role as monitor though?
We provide advice to the Minister on the performance reports of the EC

The Electoral Commission held a comprehensive review of the delivery of the election, including the use of
the Manurewa Marae as a voting place. An explanation was included in the report to Parliament in May 2024.
was part of the Justice Select Committee’s inquiry into the 2023 General Election and was commented on in
their report. including revised selection guidance
The Electoral Commission has answered questions about the voting place at committee hearings, both for the

inquiry into the election, and the Commission’s annual review. The CE appearing before the Committee did
acknowledge that he did not give enough weight to the conflict of interest at the time.
The Electoral Commission has reviewed its selection criteria with regard to the selection of voting places,
including how conflicts of interest are identified and dealt with. These are expected to be provided to the EC
Board in April. These guidelines will be made public after that.
NB: There are some challenges to work through in the guidelines such as if a Principal of a school runs
as a candidate should the school hall not be able to be utilised? School halls are a commonplace for
voting venues.
NB: we could recommend that there is external advice/review of those guidelines
Therefore, at this time we do not recommend an inquiry is necessary as there have been a number of reviews and
recommendations for improvement. Processes and guidelines have been reviewed and will be made available after its Board
meeting. There could be some additional scrutiny on the guidelines before they are released. The MOJ could recommend this
to the Minister as part of our advice on options.  
If an inquiry is determined to be the prudent option, we suggest the Auditor-General undertake an urgent inquiry. This would
have implications on the Commission’s improvement programme underway (prior OAG recommendations) and on its
readiness for the General Election 2026.

surrounding region), political neutrality, disability and mobility access, storage, and security.. We provide all registered
political parties with a list of proposed voting places for consultation before they are finalised.”
A diverse variety of voting places were assessed and secured, including malls, supermarkets,  marae, schools, tertiary
institutions, community centres, sporting venues, churches, mosques, temples, and other community spaces. As part of
this work, 15 Kaupapa Māori voting places were secured where people could go through the voting process in te reo
Māori.
In response to low voter turnout patterns for Māori voters in Auckland, we engaged with local contacts, who
recommended we use Manurewa, Papakura, Ruapōtaka, and Ōrākei Marae.

Concerns were raised about the selection of Manurewa Marae as a voting place. Various government-delivered and
government-funded services are delivered from this marae, which made it a well-known location in the community. We
were aware of a candidate’s involvement with marae management during the selection process. Before agreeing to use
the venue, we secured agreement the candidate would not enter the voting place other than to vote. We were provided
with an alternative designated contact person and ensured marae staff were aware of the rules regarding election
advertising. Despite these arrangements, some people questioned the political neutrality of this venue. We will be
reviewing our guidance on political neutrality in the selection of voting places

Have added in the policy-related text (which is, of necessity, very nuanced!) and tracked in some
comments/suggestions on the rest.
As we briefly discussed earlier, and as I mentioned briefly Sheridan yesterday too, I do wonder if there is a
‘half-way house’ option we should provide to the minister which wouldn’t be a review of the EC per se, but
would involve (with the agreement and consent of the new chair) focused work on bolstering the Board’s
governance capacity and capability, and supporting a thorough review of the Board’s processes and
practices. This option could come across as being more practical and forward looking – otherwise they are
basically left with do a review or don’t, s9(2)(g)(i)
I’m thinking of a half-way option as something like “encouraging” the board to bring on one or two
independent outside expert advisors to help them sharpen up their governance practices  (maybe someone
form the IOD or similar). They couldn’t be formal Board members with statutory decision-making power

because that is restricted under the EA, but they could help provide greater confidence in the resilience and
risk-management capacity of the Board ahead of GE 2026. The Chair has already said to the minister he 
thinks the board is too small – and we are progressing a change to eth EA to address that – but in the

Re the EC and complaints – Karl and I spoke earlier this afternoon. The EC did receive complaints of ‘treating’ at
the Marae, the location and the perceived conflicts of interest.
Complaints and enquiries about voters being offered food during the advance voting period
The EC did receive complaints about activities at Manurewa Marae, including whether the provision of
food could be considered treating.
ACT 1982
The threshold for establishing treating is high and a corrupt intention is required. 
The EC worked with the marae to ensure they understood the rules around treating.
The advice from the EC was that access to any food or entertainment shouldn’t be dependent on voting
but should be made available to anyone coming to the Marae, whether they were voting or not.
Having considered the matter, the Commission did not refer it to the Police because they did not
consider the activity amounted to treating.
The treating offence has been in the legislation a long time. The EC suggested that it would be timely for
Parliament to consider the current offence with a view to providing more guidance and clarity about
what does and does not constitute treating.
Conflict of interest
The EC also sought assurances that the candidate would not be involved in any way in the voting place.
They sought these assurances before agreeing to use the venue which was recommended by the
community.
INFORMATION 
The EC secured agreement that the candidate would not enter the voting place other than to vote and
the EC was provided with an alternative designated contact person to deal with. (refer pg 77 of our
Report on the 2023 General Election: Report-on-the-2023-General-Election.pdf). As part of the EC
review of the election, they have reflected on those arrangements. At the Justice Committee hearing on
3 December, when asked about the arrangements, the CE accepted that we did not give enough weight
to the perceived conflict of interest. 
Complaint: Text message referral
Shortly after the 2023 election, the EC received complaints about a text message promoting Te Pāti
Māori that did not include a promoter statement.
This matter was looked into by the EC and they referred the complaint to the Police – see website
notice from November 2023. This is still with the Police.
We are working away on the draft paper and hope to have something across in the next few hours after it’s had
some initial review by policy and Edrick

Any revision or process review underway regarding voting venues in light of the inquiry into Manurewa marae?
Processes have existed for the selection of voting venues and these are/were approved by the CE.**
The EC:
The Electoral Commission held a comprehensive review of the delivery of the election, including
the use of the Manurewa Marae as a voting place. An explanation was included in the report to
Parliament in May 2024.
Was part of the Justice Select Committee’s inquiry into the 2023 General Election and was
commented on in their report. including revised selection guidance
The Electoral Commission has answered questions about the voting place at committee
hearings, both for the inquiry into the election, and the Commission’s annual review. The CE
appearing before the Committee acknowledged that he did not give enough weight to the
conflict of interest at the time.
The Electoral Commission has reviewed its selection criteria with regard to the selection of
voting places, including how conflicts of interest are identified and dealt with. These are
expected to be provided to the EC Board in April. These guidelines will be made public after that.
NB: There are some challenges to work through in the guidelines such as if a Principal of
a school runs as a candidate should the school hall not be able to be utilised? School
halls are a commonplace for voting venues.
NB: we could recommend that there is external advice/review of those guidelines

Given the amount of work looking at these matters to date, we do not recommend an inquiry is necessary as
there have been a number of reviews and recommendations for improvement. Processes and guidelines have
been reviewed and will be made available after its Board meeting.
If an inquiry is determined to be the prudent option, we suggest the Auditor-General undertake an urgent
inquiry. This would however have implications on the Commission’s improvement programme underway (inACT 1982
relation to prior OAG recommendations on other matters that arose after the 2023 election) and on its
readiness for the General Election 2026.
The Commission itself engaged with the OAG to request an inquiry on the voting count issues that arose after
the 2023 election. This demonstrates their willingness to be transparent, to look for improvement opportunities
and their receptiveness to external advice.

communities’ feedback. Every voting place is assessed for suitability, and criteria include the convenience of
locations, suitable operating times, shared electorate voting (offering an ordinary vote based on the likely

security.. We provide all registered political parties with a list of proposed voting places for consultation before
they are finalised.”

Monitoring role
Our role as monitor:
o The Ministry meets regularly with the Electoral Commission and similarly the Minister meets
regularly with the Board and the Chief Executive. His next meeting is 25 March 2025.
o We provide quarterly advice to the Minister on the financial and non-financial performance of EC,
as well as key risks.
o We support the Minister to provide his expectations to EC and comment on EC’s strategic
documents.
o We support Board appointments.
Leading up to the 2023 General Election, the Ministry actively participates in the Commission’s Senior
Officials Committee and the Risk and Security working group. These are cross-agency groups established
to ensure effective coordination of election processes across government agencies and provide support
in managing potential and actual disruption to the event.
A monitoring approach is being developed, for agreement by the Minister, that will articulate the
Ministry’s approach to monitoring all Crown entities.
Other notes
The Minister of Justice has asked for a revised Letter of Expectations to be developed that will explicitly
include an expectation that the EC review their processes and procedures with regard to voting venues.
This LOE is expected to be sent to the EC within the next few weeks [can we do this sooner?].
