Thank you for your email of 31 July 2025 to the Ministry of Business, Innovation and Employment (MBIE)
requesting, under the Official Information Act 1982 (the Act), the fol owing information:
Can you provide any and all information / links about any determinations MBIE has made in the
last 5 years (since 2020) about what the specifications are or qualities in which shipping
containers are /are not deemed dwel ings / household units / accessory buildings etc (other ruling)
and under what requirement they need resource consents please. The territorial authority is WCC
(Wel ington).
MBIE is refusing this part of your request under 18(d) of the Act, as the information requested is publicly
available.

I recommend you use the Building CodeHub website to search for determinations using key words. In the
drop-down box named ‘Information Type’, select “Determination” then enter key words such as “shipping
container” to find determinations that contain those words.
Please note that determinations are issued under the Building Act and therefore determinations have no
jurisdiction under the Resource Management Act (which governs resource consents). I recommend that
you contact Wellington City Council for information on resource consenting.
