I refer to your request under the Local Government Official Information and Meetings Act 1987 (the
Act) of 23 July 2025 for information regarding penguins in the Waimakariri District. In accordance
with Section 13 of the Act, we can advise as follows:
Question 1
Does the Council agree that penguins exist on beaches in their area?
Response 1
There are no penguin colonies in the Waimakariri District.
Question 2
Does the Council agree that penguins are adversely affected?
Response 2
The Council acknowledges that there are threats to penguins at their land-
based breeding sites, such as cats, ferrets and stoats. Penguins are also
adversely affected by vehicle strikes and dog attacks.
Question 3
Do they have plan objectives concerning them? (biodiversity, fauna)
or similar?
Response 3
As there are no penguin colonies in the Waimakariri District, the Council has
no specific plans or policies regarding the protection of penguins.

As there are no penguin colonies in the Waimakariri District, there are no
specific rules in the Waimakariri District Plan regarding the protection of
penguins.

The Council considers the effects of any proposed development in the coastal
environment on the health, safety, and habitats of any wildlife, including
penguins.

Are there dog control bylaws over beach areas?

The Council’s Northern Pegasus Bay Bylaw 2024 regulates recreational
activities along the coastal strip of the Waimakariri District. Since its
introduction in 2010, the bylaw has been instrumental in improving coastal
management for Northern Pegasus Bay. It restricts vehicular and dog access
to beaches to control the negative impact on ecosystems and wildlife.
The Council also has a Dog Control Bylaw 2019 to ensure that owners are
responsible for their dogs in public places such as beaches.
