Where indicated, I have decided to withhold some information in accordance with section
9(2)(a) of the Act, to protect privacy. I do not consider that the withholding of this information
is outweighed by public interest considerations in making the information available.

The Council member who left the Board fil ed a role that is nominated by the Association of
Consulting and Engineering (ACE). In accordance with the legislative requirements (section
50(1)(a) of the Chartered Professional Engineers Act 2002), nominations from ACE were
requested.

ACE nominated one member, David Fennell, who was subsequently shortlisted, interviewed
and appointed by the Minister. Existing member, Megan Neil , was reappointed by the
Minister.
There were no applications received from the public as there was no public application
process for either the appointment or reappointments. Subsequently, there was no
advertisement. We also did not call for nominations from nominating agencies.

You have the right to seek an investigation and review by the Ombudsman of this decision.
Information about how to make a complaint is available at www.ombudsman.parliament.nz
