Official Information Act request relating to the designation of the American Proud
Boys
Thank you for your Official Information Act 1982 (the Act) request received by the
Department of the Prime Minister and Cabinet (DPMC) on 4 July 2025. You requested
(numbering added):
[1] copies of advice given to the Prime Minister and/or Minister of Police
regarding the designation of Proud Boys as a terrorist organisation either in
advance of, or subsequent to, its listing being allowed to lapse in 2025.
[2] Any information whether in written or verbal briefings, emails or texts since
its listing as a terrorist organisation about New Zealand citizens or residents
who identify or present themselves as “Proud Boys”' on social media
On 11 July 2025 your request was transferred in part to both the Prime Minister and Minister
of Police as it related to advice received by them.
This response relates to any DPMC information relevant to either part of your request.
DPMC is currently preparing for publication the documents relevant to the decision of
whether to renew the designation of “The American Proud Boys” as a terrorist entity under
the Terrorism Suppression Act 2002. The documents include any relevant DPMC advice
provided to the Prime Minister or his office both prior to and after the designation lapsed.
All the relevant documents will be published within the next fortnight on the DPMC website
at: www.dpmc.govt.nz/publications. Accordingly, I have refused Part [1] of your request under section 18(d) of the Act – the
information requested will soon be publicly available, subject to some information being
withheld under sections 6 and 9 of the Act.
In making my decision, I have considered the public interest considerations in section 9(1) of
the Act. No public interest has been identified that would be sufficient to outweigh the
reasons for withholding that information.
No DPMC information has been identified in scope of Part [2] of your request since the
designation of American Proud Boys in 2022. This part of your request is refused under
section 18(e) of the Act, as the document does not exist or cannot be found.
You have the right to ask the Ombudsman to investigate and review my decision under
section 28(3) of the Act.
