Ref: PMO OIA 466-2024-25
Dear Michael Riconosciuto
Official Information Act request: American Proud Boys terrorist designation
Thank you for your Official Information Act 1982 (the Act) request, received on 30 June 2025.
You requested:
“
I request any information held by PMO regarding the expiry of the terrorist
designation for the American Proud Boys.”
I wrote to you extending the time limit for response by 8 working days. The additional time
was needed to complete consultations before a final decision was made on your request. I
am now in a position to respond.
As previously advised, the Department of the Prime Minister and Cabinet (DPMC) is
currently preparing for publication the key documents relevant to the decision of whether to
renew the designation of “The American Proud Boys” as a terrorist entity under the Terrorism
Suppression Act 2002. Accordingly, I refused your request as it related to these documents
under section 18(d) of the Act.
The remainder of information identified as held by this office about the expiry of the
designation of the American Proud Boys consists of email correspondence. Most of this
correspondence is between this office and DPMC officials. This correspondence has been
assessed for release together with all related DPMC correspondence and documents.
Since I last wrote to you, it has been decided to include all the related correspondence and
documents in the planned proactive release of documents.
As the remaining information identified in scope of your request is now to be published, I now
refuse the remainder of your request under section 18(d) of the Act – the information
requested wil soon be publicly available. The release of this email correspondence wil be
subject to some information being withheld under sections 6 and 9 of the Act.
I have considered the public interest considerations in section 9(1) of the Act. No public
interest has been identified that would be sufficient to outweigh the reasons for withholding
that information.
The publication of both the key documents and related correspondence and documents is
scheduled for this week. The documents wil be published on the DPMC website at
www.dpmc.govt.nz/publications.
You have the right to ask the Ombudsman to investigate and review my decision under
section 28(3) of the Act.
Yours sincerely
Cameron Burrows
Chief of Staff
