Just following up on your text message:
 
Hi Wes, I just had a phone call from Doug Leeder, he was asking after getting
something in writing to councils re the 1mil Minister McClay & Simminds are agreeing
with Rotorua Lakes.
 
As discussed, I’ve drafted up an email that gives him some temporary confidence in
the agreement from a Crown perspective and also get us confirmation of their
contribution….though a 3-party agreement is likely need to formalise the overarching
agreement that the Ministers negotiated.

Hi Doug,
 
I followed up with Wes Patrick, Manager of the Environmental Investments Team who
manages the Lake Tarawera Deed of Funding.
 
This morning, Wes received direction from Minister Simmonds Office to initiate a
variation to the Deed, which would increase Crown funding from $6.5 million to $7.5
million.  His Team is currently progressing that variation through leadership review
and sign-off, and is aiming to send it over to RLC for counter-signing on Friday or





Monday.
 
Under the current Deed of Funding, BOPRC has already contributed $750,000 in co-
funding towards the project. Wes Patrick has asked if you could confirm that BOPRC
is willing to contribute an additional $1 million, so that he can document that in the
co-funding section of the variation to the Deed of Funding (bringing your total
contribution to $1.75 million). We understand this additional contribution is
contingent upon both the Crown and RLC also contributing an additional $1 million
each. Additionally, there is an extra $600,000 being provided by a rate payer
agreement, though we have not yet received specifics on that provision.
 
Since the Deed of Funding is between MFE and RLC, your co-funding contribution is
not binding under the agreement as BOPRC is not a signing party. Therefore, we will
likely need a separate document to formalise the agreements among BOPRC, RLC,
and the Crown.  We can follow-up on that front after consulting our legal team.
