Response to your request for official information
Thank you for your request under the Official Information Act 1982 (the Act) to the Ministry of
Health – Manatū Hauora (the Ministry) on 18 June 2025 for information regarding decisions
made under the Health (Fluoridation of Drinking Water) Amendment Act 2021. Please find a
response to each part of your request below:
1. Copies of any internal or external reviews, briefings, scientific assessments, or
correspondence since 1 August 2024 that evaluate or respond to the National
Toxicology Program Monograph 8 (2024, updated 2025), titled “Fluoride and
Neurodevelopmental Outcomes.”
The Ministry has considered key recent publications on community water fluoridation, including
the US National Toxicology Program Monograph on the State of the Science Concerning
Fluoride Exposure and Neurodevelopmental and Cognition published in August 2024. You can
find the Ministry’s consideration of this, and other key publications, in
Appendix 2: The Manatū

2. Any documents, memos, or legal advice reflecting how the Director-General of Health
has considered Section 92I(5) of the Health Act 1956, which prohibits compulsory
medical treatment, in relation to water fluoridation directives issued under Section
116C.
Fluoridation is regulated under Part 5A Fluoridation of Drinking Water of the Health Act 1956.
Section 92I is contained in Part 3A of the Health Act 1956, which pertains to giving directions to
individuals to manage infectious diseases. This part of your request is therefore refused under
section 18(g)(i) of the Act as the information requested is not held by the Ministry and there are
no grounds for believing that the information is held by another agency subject to the Act.
3. Any internal or commissioned Ministry of Health evaluations of non-oral fluoride
exposure, such as transdermal (skin) or aerosol/inhalation absorption from fluoridated
public water supplies.
The Ministry does not hold any information related to this part of your request. Therefore, this
part of your request is refused under section 18(g)(i) of the Act.
