You wil be required to complete vendor setup forms (if not a
current vendor) and submit a valid tax invoice.
Documentation
• The final stage programme must be completed in the template
provided by TAU.
• Signed LOA must be returned to TAU by 12 December 2024
Payment
• A 50% deposit payment wil be made on return of signed LOA
• The 50% balance shal be made following Pasifika Festival 2025 on 20 April 2025
• Payment shall only be made on receipt of valid tax invoice and required documentation as
stipulated by TAU.
General
• The programmer shall exercise reasonable skill, care and diligence in completing the Festival
contemplated by this agreement and will co-operate with Council.
• The programmers wil ensure that the Festival/performance does not contain material or
actions likely to cause offence.
• The programmer shall comply with all health and safety legislation, codes of practice and TAU
Health and Safety policies and procedures. If at any time an issue is raised by TAU regarding
health and safety, the programmer agrees to take al reasonable steps to rectify the situation.
• The programmer continually indemnifies TAU, its officers, employees, and agents against any
claim or proceeding and against any loss, liability or expense arising from:
o Negligence by the programmer or anyone for whom the programmer is responsible
in connection with the Festival
o Any breach of this agreement.
Consents
By signing this document, you, and the performers, grant TAU (Including it’s sponsors, sponsored
parties and duly authorised agents) the right to:
(i) change or cancel the performance, in its sole and absolute discretion, in the following
circumstances:
• bad weather that the Festival has to be changed, postponed or cancelled.
• the performer failing to appear in time for the al ocated performance time slot
• the content of the performance, including costumes, music, lyrics etc., not supporting the
culture and values of the Festival
• props and equipment etc. being non-compliant to TAU Health and Safety guidelines or
potential y damaging the heritage or environment of the venue
(ii) alter the programme due to unexpected delay, which might result in cancellation of later
performances.
(iii) take recordings of the programmer during planning meetings, workshops and at the event for
promotional purposes only.
(iv) use the Recordings for the Permitted Purpose worldwide during the Term, free of charge.

(v) TAU shal not be required to give attribution to the programmer but may choose to do so where it
considers appropriate. For the purpose of any attribution, the programmer grants TAU the right to use
the programmer's name, likeness, and any other relevant details about the programmer.
Photograph the programmer and personnel onsite and may be used by TAU for
marketing and promotional use.
TAU’s Obligations
• TAU will be responsible for any security, consents or licences which are necessary, or it
considers appropriate for the Event.
• TAU will be responsible for all advertising, publicity, ticketing, flyers and promotion of the
Event.
• TAU will take out at its own cost public liability insurance cover on behalf of the programmer
during the Event.
