Document 1
Aide memoire summarising the Law Commission’s
recent reviews of the Evidence Act 2006

Hon Kiri Allan, Minister of Justice
15 July 2022
1982
The Law Commission’s Second Review
ACT
Many of the issues raised require further policy work, which is not currently resourced
10. Some initial policy analysis progressed in 2020 but was put on hold because of Covid-19
reprioritisation.  Since then, no substantive work has occurred on these issues as other
Ministerial priorities have taken precedence.
11. The issues from the second review still requiring further policy work include:
• admissibility of evidence about previous convictions;
12. If you would like to resume work on developing an Evidence Amendment Bill, this will
require consideration of the wider policy group work programme. Alternatively, you may
consider keeping the work on hold until after the Law Commission reports on its third
review in 2024 (see below) so that any changes can be included in one Evidence
Amendment Bill.
