RESOURCE CONSENTS SOUGHT UNDER THE FAST-TRACK
APPROVALS ACT 2024
In respect of the resource consents sought under the Resource Management Act 1991
(“
RMA”) through the fast-track application, the establishment, operation and rehabilitation
of the BOGP must be considered against the rules and regulations of the following statutory
planning documents:

The tables in the following sections set out each of the consents required for the BOGP as
relevant to the Otago Regional Council – being the Regional Water Plan, Regional Air Plan,
Regional Waste Plan and Freshwater NES – with a summary of the overall status of the
proposed BOGP under the RMA presented at the end of this analysis.

REGIONAL PLAN: WATER FOR OTAGO

5.
SUMMARY OF RESOURCE CONSENT REQUIREMENTS
5.1
REGIONAL PLAN: WATER FOR OTAGO
Based on the analysis set out in Section 2 of this rules assessment, the following resource
consents are required under the Regional Water Plan:
A water permit as a
discretionary activity for the take and use of groundwater from the
Bendigo Aquifer for water supply to support mining operations;
A water permit as a
discretionary activity for the diversion, take and use of surface
water during the construction and operation of mining operations;
A discharge permit as a
restricted discretionary activity to discharge stormwater,
water and associated contaminants to diversion drains to land and / or water;
A discharge permit as a
discretionary activity to discharge contaminants from waste
rock stacks and tailings storage to land where contaminants may enter water;
A discharge permit as a
discretionary activity to discharge treated mine water from the
water treatment plant to land and / or water;
A land use consent as a
restricted discretionary activity to use structures (including
culverts) in the bed of streams;

Based on the analysis set out Section 4 of this rules assessment, the following resource
consents are required under the Regional Waste Plan:
A land use consent as a
discretionary activity for the disturbance of contaminated land
due to naturally elevated levels of arsenic present within parts of the project site; and
A discharge permit as a
discretionary activity for the discharge of contaminants into or
onto land, into water or into air associated with the treatment or disposal of hazardous
wastes from the processing plant and discharge of tailings into the Shepherds Tailings
Storage Facility.

5.4
RESOURCE MANAGEMENT (NATIONAL ENVIRONMENTAL STANDARDS FOR
FRESHWATER) REGULATION 2020
Based on the analysis set out in Section 5 of this rules assessment, the following resource
consents are required under the NES Freshwater:
A land use consent as a
discretionary activity for vegetation clearance and earthworks
(for the purpose of the extraction of minerals and ancillary activities) within 10 m of a
natural inland wetlands;
A land use consent as a
discretionary activity for earthworks and land disturbance (for
the purpose of the extraction of minerals and ancillary activities) within 100 m of natural
inland wetlands that is likely to result in the complete or partial drainage of all or part of
the wetland;
A discharge permit and water permit as a
discretionary activity for the diversion and
discharge of water (for the purpose of the extraction of minerals and ancillary activities)
within 100 m of natural inland wetlands; and
A land use consent as a
discretionary activity for the reclamation of the bed of a
watercourse.
