CONFIRMATION OF PROVISION OF ARBITRATION SERVICES
Thank you for confirming your availability to act as an arbitrator in respect to the renewal
of the Police constabulary collective employment agreement. The service organisations
(unions) have confirmed your acceptability to act as arbitrator should this be required.
The appointment is made pursuant to Schedule 2 of the Policing Act 2008 which details
the procedure for final offer arbitration for our constabulary workforce.
Background
The current employment agreement expired 30 June 2023 and the parties have been
engaged in bargaining to conclude a new agreement. The agreement is a MUCA and
includes the following parties:
NZ Police
Police Association
Police Leaders Guild
Rates
We have agreed an hourly rate of $380 + GST + disbursements and expenses. Payment
wil be made upon provision of an invoice to NZ Police.
Services required
Should Final Offer Arbitration (FOA) be invoked we wil be in contact and further
information can be supplied at that time.
To move to arbitration requires the agreement of all parties. This would normally follow
provision of mediation services with the parties making all reasonable efforts to come to
an agreement. We have an existing and on-going relationship with Mediator Mike Feely
who is assisting the parties during negotiations.

A high-level outline of the required services includes:
Review of background information
Review of each parties’ “final offer”
Review of the bargaining process undertaken
Acting as an arbitrator in any required hearing. This wil include discussion with
the parties, hearing of evidence, and consideration of all evidence presented,
and making a determination that is binding on the parties
Provision of a written determination.
