Official Information Act request: [Dan] Use of personal email accounts by Ministers for
official business
Thank you for your Official Information Act 1982 (the Act) request, received on 12 May 2025.
You requested:

The root cause or causes identified by DPMC (or any relevant oversight body) that
led to the use of a personal email account by Hon. Erica Stanford for ministerial
matters, including pre-Budget documents.

How and when this issue was first detected, including whether it was identified
through internal monitoring, an external inquiry, an Official Information Act request, or
another channel.
[3]
What actions have been taken or are planned to address this incident and to
prevent recurrence across Ministers or other government officials (e.g. updates to the
Cabinet Manual, training, technical or security controls).

A copy of any internal reports, reviews, briefings, or correspondence (including
emails and memos) held by DPMC that relate to this incident.
[5]
A copy of any emails sent from ministerial or MP accounts to personal email
addresses, covering the period from 1 January 2024 to 1 May 2025, where those
emails relate to official government or ministerial business.”
Your request was transferred to the Prime Minister from DPMC.
Response to your request
I have numbered the different sections of your request to address each in turn.
Parts 1 to 3
Information regarding Hon Stanford’s use of a personal email account was released by her
office as part of a response under the Official Information Act 1982. The Prime Minister has
commented that the Cabinet Manual guidance allows for use of personal accounts when
unavoidable. The Prime Minister stated Hon Stanford experienced technical issues and has
subsequently put in processes in place to address this.
The Prime Minister has reminded Ministers about the guidance at paragraphs 2.86-87 of the
Cabinet Manual.
Part 4
The Prime Minister holds information relevant to this part of your request. I have decided to
release this material subject to withholding certain sections as detailed in the table below.
Please find this information attached. Item 3 which is withheld in full has not been provided.
The relevant grounds under which information has been withheld are:
1. section 9(2)(a), to protect the privacy of individuals
2. section 9(2)(f)(iv), to maintain the confidentiality of advice tendered by or to
Ministers and officials
3. section 9(2)(g)(i), to maintain the effective conduct of public affairs through the free
and frank expression of opinion.

In making my decision, I have considered the public interest considerations in section 9(1) of
the Act. No public interest has been identified that would be sufficient to outweigh the
reasons for withholding that information.
Part 5
I have interpreted this part of your request as asking for information held by the Prime
Minister, this being any emails sent from the Prime Minister’s official accounts to his personal
account covering the period from 1 January 2024 to 1 May 2025, where those emails relate
to official government or ministerial business. I invite you to make this request to other
Ministers directly as it related to individual Ministers. I note Members of Parliament who are
not also Ministers or Parliamentary Under-Secretaries, are not subject to the Act.
No such emails exist for the Prime Minister. I must therefore refuse your request under
section 18(e) of the Act on the basis the information does not exist.
You have the right to ask the Ombudsman to investigate and review my decision under
section 28(3) of the Act.
