Response to your request for official information
Thank you for your request under the Official Information Act 1982 (the Act) to the Ministry of
Health – Manatū Hauora (the Ministry) on 30 April 2025 for information regarding the approval
of the vaping premises AVP-1009. You requested:
“This request concerns the licensing of the vaping premises AVP-1009.
The Ministry’s website shows this premises as being approved, however the licence
‘effective dates’ appear to indicate otherwise.
Could you please confirm whether AVP-1009 holds a current approval?
Only if the approval remains current, please provide:
- The date on which the application by the vaping premises was made; and
- All decision-making documentation for the application.”
RJMM Limited is the legal entity operating from 16 McCarthy Street, Hoon Hay, Christchurch
8025, under approved vaping premises (AVP) approval (AVP-1009). The Ministry received an
AVP application for Hoon Hay Convenience store on 20 December 2022 and granted specialist
vape retailer (SVR) approval for the premises on 9 January 2023.
Owing to an administrative error the approval, reference AVP-1009, was issued against the
trading name Hoon Hay Convenience Store, not the legal business entity. To ensure the AVP
approval was linked to the correct business entity in the Ministry’s regulatory platform, HARP, a
new SVR approval was issued to RJMM Limited on 4 April 2025, as well as linking the existing
AVP approval (AVP-1009) to RJMM Limited. The specialist vape retailers public register
currently shows the SVR approval date.
For context, the SVR is the approval for the company/business, while the AVP is the separate
approval date for the physical store. These two dates do not always match, and a single SVR
can be linked to several AVPs approved at different times. A permanent solution to this issue for
the public register is currently underway, however, this wil take some time.
The Ministry has identified 13 documents within scope of your request. Al documents are
itemised in Appendix 1 and copies of the documents are enclosed. Where information is
withheld under section 9 of the Act, I have considered the countervailing public interest in
releasing this decision and consider that it does not outweigh the need to withhold at this time.
