Thank you for your letter of 27 April 2025 to the Ministry of Business, Innovation and Employment (MBIE)
requesting, under the Official Information Act 1982 (the Act), the following information:
The US government announced in Jan 2025 that it would reinstate with back pay the 8000
discharged military workers who objected to Covid 19 vaccine mandates. Only 43 rejoined according
to the 4 December 2024 Whitehouse report

For 2021 onwards, would you please share
1 the number of reinstatements for any unvaccinated workers by year as a result of MBIE mediations
and Employment Relations Authority determinations.
2. The number of appeals to the employment court for vaccine mandates by year since 2021.
3 the number of unvaccinated workers burdened with legal costs as a result of employment relations
authority determinations (from the daily tariff of $4500 for the first day)
4 To the chair of the Employment Relations Authority: please share any reviews, memos, comments
and correspondence on this December 2021 US Whitehouse report on Covid regarding vaccine
mandated workers particularly page 320 onwards about findings (link above).
Questions 1 (the part in relation to the Employment Relations Authority), 2 and 3 are refused under
section18(d) of the Act as the information requested is publicly available. You can find the information at

Regarding question 1 in relation to MBIE’s mediation services, this information does not exist. This part of
the question is refused under section 18(e) of the Act, as the documents al eged to contain the
information requested do not exist.
There are no reviews, memos, comments or correspondence from the Employment Relations Authority on
the article referred to in your email, therefore question 4 is refused under section 18(e) of the Act, as the
documents al eged to contain the information requested do not exist.
