No action required, for your awareness only
NZDF are expecting a decision from the Supreme Court in the case of CDF v Four Members this Friday at 1000.
As you are aware, the case is about the requirement to have a COVID vaccination and the retention review process for
servicepersons who refused vaccination. It has been all the way through the High Court (NZDF won), to the Court of
Appeal (NZDF lost), and finally to the Supreme Court on appeal by the NZDF & Crown Law. The case before the
Supreme Court involved arguments about the fundamentals of CDF’s ability to command the armed forces, so the case
could have long term legal implications for the NZDF.
I will let you know the outcome in due course.
