Candidate Information Sheet – Gambling Commission
Purpose
The Gambling Commission (the Commission) was established under section 220 of the
Gambling Act 2003 (the Act). The Commission is appointed by the Governor-General and is
an independent decision-making body with the powers of a Commission of Inquiry. It is a
quasi-judicial body that hears and makes determinations about casino licensing applications,
and appeals on licensing and enforcement decisions in relation to gaming machines and
casinos.
Affairs
The key functions of the Commission under section 224 of the Act are:
•
specifying, varying and revoking casino licence conditions;
•
deciding on applications by the Secretary of Internal Affairs to suspend or cancel casino
licences;

determining applications for casino operators’ licences and the renewal of casino venue
of
licences;
•
approving agreements and changes to agreements between casino operators and
casino venue licence holders;
•
determining appeals against regulatory and licensing decisions made by the
Department of Internal Affairs (the Department) in relation to gaming machine
operations and other gambling involving prizes of more than $5000;

hearing complaints about the way the Department has handled complaints in relation
to gambling activities;

advising Ministers on the setting of the problem gambling levy; and
•
advising the Minister of Internal Affairs on matters relating to the performance of the
Commission’s functions and the administration of the Act.
Gambling Commissioners
Released
The Governor-General appoints up to five commissioners on the recommendation of the
Minister of Internal Affairs. Commissioners are appointed for a term of up to three years
and may be reappointed. Unless commissioners vacate office sooner, they continue in office
until they are either reappointed or a successor is appointed.
Skills and attributes required
•
previous knowledge and experience in the gambling sector;

governance experience; and
•
legal background.

Commitment
The Commission meets monthly between February and December each year.
Commissioners are also expected to spend around one day in preparation for each meeting.
Meetings are mainly in Wellington but there may be additional travel required throughout
New Zealand.
Remuneration
The daily meeting fee is $475 for commissioners. Reasonable travel expenses will be
reimbursed.

matter that may make their appointment inappropriate. The Department may check the
accuracy of any information relating to an application for appointment. Internal
