Thank you for your email on 17 April 2025, asking Health New Zealand | Te Whatu Ora for the
following under the Of icial Information Act 1982 (the OIA):
1.
The official date Lester Levy commenced his role as Commissioner of Health New
Zealand.
From that date until the date this request is received:

The total number of Official Information Act (OIA) requests received.
3.
The number and percentage of OIA requests responded to within the statutory
timeframe.
4.
The average (mean, median, mode) response time for all OIA requests.
5.
The number of extensions issued under section 15A of the Act.
6.
The number of OIA-related complaints made to the Office of the Ombudsman, and
the outcome of those complaints (e.g. resolved, upheld, declined, ongoing).
7.
A copy of Health New Zealand’s current internal policy or guidelines for handling
OIA requests, including documents outlining staff responsibilities, escalation
processes, and response procedures.
8.
Details of any reviews, audits, internal assessments, or process improvements
made to Health New Zealand’s OIA handling practices since Lester Levy’s
appointment - particularly those initiated in response to Ombudsman
recommendations or public feedback.
Not for this request, but I wil ask for this information in the future once the above has been
addressed. A full copy of all OIA requests received by Health New Zealand from the date
Lester Levy began his role, along with all associated correspondence and responses. This
includes:
- The original request submitted.
- Any internal or external communications discussing the request.
- The final response issued to the requester.
This request is made in the public interest, in light of recent commentary regarding
transparency and accountability in the New Zealand public health sector.
Response
For clarity, I wil respond to each part of your request in turn.
1. The official date Lester Levy commenced his role as Commissioner of Health New Zealand.
I can confirm that Lester Levy commenced his role as Commissioner of Health New Zealand on
22 July 2025.
From that date until the date this request is received:
2. The total number of Official Information Act (OIA) requests received.
3. The number and percentage of OIA requests responded to within the statutory timeframe.
4. The average (mean, median, mode) response time for all OIA requests.
5. The number of extensions issued under section 15A of the Act.
6. The number of: (a)OIA-related complaints made to the Office of the Ombudsman, and (b)
the outcome of those complaints (e.g. resolved, upheld, declined, ongoing).
As you may be aware, every six months the Public Service Commission | Te Kawa Mataaho
(TKM) publishes statistics on agency compliance with the OIA. These cover points 2 – 6 (a) of
your request. You can find the statistics for the most recent reporting period, 1 July 2024 – 31

The Chief Ombudsman also publishes data on OIA complaints received and completed on a six-
monthly basis. These include the number of complaints received and completed (including
outcome as per point 6(b) of your request). You can find the Chief Ombudsman’s statistics for the

We acknowledge there is a strong public interest in agencies being open, transparent and
accountable for their performance under the OIA and we consider that interest to be met by both
TKM and the Ombudsman’s regular publication of information on agencies’ compliance with the
OIA. At empting to collate a bespoke dataset, outside of regular reporting cycles, to meet the
exact date parameters of your request (22 July 2024 – 17 April 2025) would be a substantial
administrative task to undertake and would impact our ability to carry out our core functions. We
are therefore refusing your request under section 18(f) of the OIA due the substantial collation and
research required to provide a complete response.
As required under section 18B of the OIA, we have considered whether extending the timeframe or
fixing a charge for the supply of this information would enable us to respond. However, we do not
consider either of these mechanisms sufficiently mitigate the administrative burden of providing this
information.

requests, including documents outlining staff responsibilities, escalation processes, and
response procedures.
We have interpreted this part of your request as referring to formal guidance prepared or endorsed
by Government Services.

8. Details of any reviews, audits, internal assessments, or process improvements made to
Health New Zealand’s OIA handling practices since Lester Levy’s appointment - particularly
those initiated in response to Ombudsman recommendations or public feedback.
Health New Zealand is commit ed to openness, transparency and ensuring we manage all OIA
requests in a timely and efficient manner.
As you may be aware, in October 2024, the Chief Ombudsman initiated an investigation into seven
agencies’ compliance with OIA timeliness obligations, one of which was Health New Zealand. You

In addition to this, in February 2025, a review was commissioned of Health New Zealand’s
Government Services function. The review sought to identify opportunities to improve the
performance, structure, and processes underpinning Health NZ’s Government Services function.
This included Health NZ’s handling of OIA requests. The outcome of this review remains under
active consideration by our Leadership Team.
Health New Zealand has made a number of improvements to our OIA handling practices, in
response to the Ombudsman’s recommendations and action points and at our own motion. These
include: improving our commissioning of requests along with our audit, tracking and reporting
documentation, increasing senior oversight of extension/decision processes, and ensuring staff
complete the Ombudsman's OIA training. Alongside this, we are also actively working with external
providers to improve our electronic case management system and ensure it is delivering maximum
efficiencies for our work.
We acknowledge there is work stil to be done to ensure our responses are consistently on time
and in accordance with our obligations under the OIA and wil continue to make improvements.
A full copy of all OIA requests received by Health New Zealand from the date Lester Levy began
his role, along with all associated correspondence and responses.
While not part of your current request, we note your intention to submit a further request for the
above information. As you wil note from the statistics referenced above, Health New Zealand
received in excess of 3000 requests from 1 July – 31 December 2024, with the number likely being
closer to 5000 for the particular period you are interested in. At empting to provide you with all
information held by us in relation to each request would be a huge administrative task to undertake
and would almost certainly result in the refusal of any such request under section 18(f) of the Act.
If you are interested in receiving further information about the nature of the requests we receive
and their outcomes, we suggest you consider restricting any further request to a summary of
requests received and their outcomes over a significantly shorter time period.
