Thank you for your email of 13 March 2025 to the Ministry of Education (the Ministry) requesting
the following information:
In her response to questions 39542/39540 in July 2024, Hon Erica Stanford stated:
"Privacy reviews are being undertaken across all progression monitoring tools to ensure
standards for privacy and data and information sharing are upheld."
I request copies of all such privacy reviews referred to in this statement.
Your request has been considered under the Official Information Act 1982 (the Act).
The Ministry has identified the following progression monitoring tools in scope of your request:
1. Electronic Assessment Tool for Teaching and Learning (e-asTTle).
2. Progress and Consistency Tool (PaCT).
3. Phonics Check.
4. Te Waharoa Ararau.
5. Hihiria Weteoro.
The privacy review documents associated with these tools are attached as
Appendix A, as set out
in the
Appendix A Document Table below, along with my decision on release.
Please note that Phonics Check and Hihiria Weteoro are included in the same Brief Privacy
Assessment (BPA) document, and that there is an error in the Business Owner sign-off date in this
document, which records the year incorrectly as 2024 rather than 2025.

Please also note that PaCT is a different tool to the Progressive Assessment Test (PAT) referred
to in the Written Parliamentary Question, which is owned and managed by the New Zealand
Council for Educational Research.
I am withholding some information within these documents under the following sections of the Act:
6(c)
as the making available of that information would be likely to prejudice the
maintenance of the law, including the prevention, investigation, and detection of
offences, and the right to a fair trial
9(2)(a)
to protect the privacy of natural persons
9(2)(b)(ii) to protect information where the making available of the information would be likely
unreasonably to prejudice the commercial position of the person who supplied or
who is the subject of the information
9(2)(f)(iv) to maintain the constitutional conventions for the time being which protect the
confidentiality of advice tendered by Ministers of the Crown and officials.
As required under section 9(1) of the Act, I have considered the public interest in releasing the
information withheld. I do not consider that the public interest considerations favouring the release
of this information are sufficient to outweigh the need to withhold it at this time.
