We’ve been engaging with colleagues at the Independent Police Conduct Authority on work they are doing to review
the legal framework governing protests.
The majority of the work will focus on the nature and effectiveness of the tools available to Police. However that
will necessarily extend to consideration of how Police and local authority powers and practices intersect, and
whether any changes or refinements are required. This includes assessment of the effectiveness of some regulations
and tools of local authorities.
Aspects they are looking at include:
What are the relevant bylaws and regulations and are they fit for purpose?
What are the relevant offences and powers available to local authorities to enforce bylaws and regulations
and are they fit for purpose?
They have been talking to some councils who have recent experience with protests, and are keen to get a broader

As a result of a number of complaints the IPCA has received following the Posie Parker protest early last year and
more recent Palestinian protests in Auckland, we have decided to undertake a review of the legal framework
governing protests to determine whether it is fit for purpose, and if not what changes are required.
We are working closely with the Police on that review, which we are aiming to complete by mid-year.

It was great to e-meet you all last week. As promised, below is a summary of the bylaw work DIA is currently doing.
If you have any questions or would like additional information please feel free to ask. Chelly and Helen, we’ve been
engaging with MoJ’s offence and penalty vetting team on this to date and would be happy to include your teams if
you thought it was relevant.
This work relates to Issues B and E in the tasking doc Warren circulated, in particular:
• Set out relevant offences and powers available to…local authorities.
• What are the relevant by-laws?
• Do the legal tools available to local authorities provide adequate enforcement powers and are they fit for
purpose?
Identify and review the tools available to… Local Government (with reference to both statute and case law) when
there is a need to engage in enforcement activities, with reference to the issues outlined above, and
compare with other jurisdictions (include comparison with UK and Australia)
In summary we are looking at a particular issue with the tools available for local government bylaw enforcement
following a Regulations Review Committee inquiry. Resolving that issue is likely to require legislation changes. More
details below for those who are interested.
Regulations Review Committee Inquiry into Bylaws
The RRC completed an inquiry into bylaws between August 2022 and August 2023, reporting to the House in
September 2023 – Inquiry into bylaws (selectcommittees.parliament.nz)
The inquiry looked at local government bylaws, with a key focus on enforcement. t noted the issue that bylaw
breaches often end up as “ghost offences” because the majority can only be enforced through court prosecution
and the resources required to do this are frequently out of proportion with the level of offending. There is a
provision in the Local Government Act for regulations to make bylaw breaches infringement offences, but this has
rarely been used (if at all). From our work to date we believe this is due in large part to a drafting error in s259 of the
Local Government Act 2002 which makes it administratively unworkable.
The RRC made three recommendations – that the Government:
1. Consider investigating why bylaw breaches are seldom designated as infringement offences.
2. Consider whether types or classes of bylaw breaches should be designated as infringement offences.
3. Formally set out its expectations for how a Minister would consider an application for a bylaw breach to be
designated as an infringement offence.
Government Response
The Government response was tabled in the House on 18 March 2024. It noted the recommendations are sequential
and best considered one-by-one as the outcome of Rec 1 will inform Rec 2, and the outcome of that will influence
Rec 3. Work is underway on Rec 1 and the Minister of Local Government will receive further advice once that’s
complete. Recs 2 and 3 will be worked on as resourcing and priorities allow.
