Re: Security plan for Te Atatū Peninsula Library
Thank you for your email dated 15 February 2025, in which you requested information about
Te Atatū Peninsula Library. The specific details of your request and our response are below.
Could you please supply me with the following:
•
the number of formal trespasses made today at Te Atatū Peninsula Library.
Under the Trespass Act 1980, Auckland Council is able to verbally warn a person to leave a
premise (section 3) or warn a person to leave and not return for a period of 2 years (section
4). A warning to leave can be issued verbally, while a warning to leave and not return is issued
as a written trespass notice and requires the person’s name and address.
One individual was verbally warned to leave, and one large group was verbally warned to
leave, twice.
•
the number of staff who had a formal delegation to trespass people who were
working at the library today.
The minimum level of authority required to issue a verbal warning to leave council premises
(under S3 of the Trespass Act 1980) is Tier 7, which all library staff have. The minimum level
of authority to issue a written trespass notice (under S4 of the Trespass Act 1980) is Tier 6,
which is the Manager Community Hub.
•
the time(s) at which each trespass was given.

A Section 3 Trespass notice does not require a time to be recorded in order to be valid. The
trespasses were issued during the time the protesters were in the facility.

the time(s) the Police enforced the above trespass notices.
In accordance with section 12 of the Local Government Official Information and Meetings Act
1987 (LGOIMA), we have transferred this part of your request to NZ Police to respond. This
is because the requested information is believed to be more closely aligned with the functions
of NZ Police. They wil respond to your request within 20 working days of receipt of your
request.

the security plan(s) made for the Te Atatū Peninsula Library event today.
We are withholding this information under section 7(2)(d) of the LGOIMA, to avoid prejudice
to measures protecting the health or safety of members of the public.

the date(s) at which the Auckland Council security team was warned about the
threats by Brian Tamaki against Auckland Pride events involving children.
The Auckland Council Security team was made aware of protest activity planned at Te Atatū
Peninsula Community Hub on Monday 10 February 2025.
•
the incident reports lodged regarding the events at Te Atatū Peninsula Library
today.
An incident report was lodged via Auckland Council’s Donesafe Incident Management system.
We are withholding the report under section 7(2)(f)(i ) of the LGOIMA, to maintain the effective
conduct of public affairs through the protection of such Ministers, members of organisations,
officers, and employees from improper pressure or harassment, and section 7(2)(a) of the
LGOIMA, to protect the privacy of natural persons.
We instead provide a high-level summary of the incident report below.
Te Atatū Peninsula Community Hub held a Pride event on 15 February 2025. Protestors were
outside the community centre from 9am to protest against this event. The protestors largely
stayed outside during the morning to protest. Some protestors came in and out of the building
but would leave without any mishap.
At about 12.30pm, when the Hugo’s rainbow show started, the protesters began to enter the
building. A confrontation occurred between a protestor and member of the public. Eventually
the protestors made their way upstairs, where Hugo’s rainbow show was held, Staff members
were pushed and injured in the process. The door to the room where the Rainbow Show was
held was securely locked so the protestors could not enter, but the protestors stayed up there
until several police people arrived about 15 minutes after the protestors entered the building.
Police were called three times regarding the protestors. First at 10am to warn police that the
protestors were growing and congregating. Then two more calls before 12.30pm when the
protestors entered the building.
