Under the terms of the Health and Safety at Work Act 2015, MBIE is deemed to a Person Conducting a
Business or Undertaking (PCBU), with obligations to provide care for its workforce. This requires us to
ensure, so far as is reasonably practicable, the health and safety of our workers. You can read more about

MBIE does not provide any posture training to its staff. As such, I am refusing your request in full under
section 18(e) of the Act, as the information requested does not exist.

Since November 2023, MBIE has contracted APM WorkCare to provide staff workplace assessments. APM
WorkCare is a provider of employment, disability, assessment, health and injury management services
across New Zealand. Prior to this, workplace assessments were provided by TBI Health Ltd which ended in
March 2024.
Please refer to the table below for a breakdown by calendar year of the total spend on workplace
assessments for MBIE staff since 2022, rounded to the nearest dollar.

When reading the column under the number of completed assessments, please note:
• The figures in this table reflect the number of unique individual assessments per calendar year.
• Workstation assessments can be simultaneously completed for multiple people, for e. g. where a
team has new staff with common start date or members of a team have been included in the
same session. However, the billing/invoice raised for these sessions can be on different dates
depending on when the sessions concluded. This means dividing the spend in a year by the
number of completed assessments will produce a rough average, but this table does not contain
information sufficient to determine the actual cost of any given session.
• The cost per assessment can also vary according to the number of assessments carried out at by
the provider on a single day and the complexity of an assessment, considering any
pre-existing conditions a staff member has.
• Because if often carries out assessments in batches when onsite, APM records assessments for a
group of people as single line item, noting a range of assessments completed (for example, 1, 2-5,
6-10, 11-15).
• For each visit, the midpoint of the assessments for that session has been included (for example,
3.5, 8, 13). Our tally is the total of these midpoints, rounded to the nearest whole number.

Cost of each assessment
The cost per assessment can vary according to the number of assessments carried out at by the provider
on a single day and the complexity of an assessment, considering any pre-existing conditions a staff
member has.
I am withholding the unit costs of each assessment type purchased by MBIE under section 9(2)(b)(ii) of
the Act, to avoid prejudice to the commercial interests of the source or supplier of the information
concerned.
This service was contracted by MBIE following a competitive tendering process, and the prices are
reflective of each company’s own work and methods, and we believe the release of this information
would cause TBI Health and APM WorkCare material disadvantage, where its competitors’ pricing
information is not on the public record.
In line with section 9(1) of the Act, I believe the public can be met with the summarised information on
page 2 of this letter.

Breakdown of assessments by region/city and month/year A breakdown of the data for the 12 months ending December 2024, by month and city is provided in the
table overleaf. However, I am refusing your request for a regional and time series breakdown of

assessments before December 2023 under section 18(f), due to the substantial collation to provide a
response. The source data for such a table is not held in a single location, and we would be required to
open and examine multiple documents and invoices to collate this information.

were looking for as Document 1, and a copy of the blank pricing template as Document 2. No information
has been redacted from these documents.
Question 3
Costs required after assessments
I am refusing this part of your request under section 18(f), as the requested information cannot be made
available without substantial collation and research. Decisions about the provision of specialist equipment
for staff are made at business unit level following a completed assessment, on the advice of a trained
occupational therapist, and the invoices for the purchases are recorded against the business groups that
purchased them. To collate the information you have requested, each individual MBIE branch or team
(depending on their size) would need to provide their own spending figures for inclusion in the response.
MBIE has over 6,000 employees and the work to compile this information would be extensive and place a
burden on departmental resources.
However, it is important to note that all equipment paid for by MBIE remains MBIE’s property, meaning
that a staff member’s needs may be able to be addressed through the provision of equipment on hand.

Decisions about purchasing equipment is based on variables such as:
• the complexity of the needs of the staff member concerned
• the advice of workstation assessment providers
• whether the staff member already has their own personal equipment
• best practice guidance around workplace safety; and
• the amount of surplus equipment available onsite at the time.

MBIE is a diverse organisation with a wide variety of job descriptions and associated health risks. Early
identification and management of dysfunction is critical to restore optimal work function. A majority of our
workers perform their role from workstations and can experience pain and discomfort syndromes due to
repetitive tasks. Workstation assessments are an important tool to ensure workers entering a new role or ACT
environment, or reporting an early pain or discomfort event, are supported and educated on effective work
setup and practices to resolve a problem and reduce risk of future health concerns. This can be
supplemented with activities such as educational resources, presentations/workshops and equipment
purchasing advice.

MBIE is not seeking a generic ‘one-size-fits-al ’ product, but a modern solution designed and tailored
toward the needs of our organisation and workers.

1.6 Our RFQ Process, Terms and Conditions

Offer Validity Period: In submitting a Quote the Respondent agrees that their

SECTION 2: Our Requirements
2.1 Background
This procurement relates to the operational delivery of the MBIE Wellbeing Health and Safety Policy which
includes workstation assessments as a support service available to all staff.
2.2 What we are buying and why
ACT
This RFQ relates to the purchase of workstation assessment as the core service. In addition to the health
and safety requirements and alongside the service deliverables indicated on the Agreement, MBIE’s
specific requirements are outlined below:
- MBIE and the supplier should meet to exchange relevant health and safety information and to
discuss planning and performance during a quarterly meeting with regular communication
between them.
- The supplier will deliver workstation assessments when requested to ensure MBIE workers are
optimally set-up and accommodated in a new role or to be completed on request for workers
reporting early pain or discomfort.
INFORMATION
- The supplier will deliver the services to all MBIE New Zealand work sites. Remote support may also
extend through tools such as presentations or teleconferences to onshore workers working from
home and offshore offices.
- Workstation assessments need to be designed to reflect differing worker needs ranging from; brief
assessments when a new work floor is populated, to a detailed assessment and reporting for a
worker with a medical history.
- Additional services may include; group workshops to educate workers on relevant topics, manual

handling training for workers that have the potential for physical injury in their role, or specific
assessments like vehicle assessments or task analysis.
2.3 What we require: the solution
THE
We are seeking a solution through workstation assessment too proactively manage signs of early pain and
discomfort. We aim to achieve this by reducing the risk of repetitive use or gradual onset injuries to our
workers combined with early and effective interventions when they present.
2.4 What we require: capacity

We are seeking suppliers that are able to demonstrate the following capacity:
• Can deliver services nationwide.
• On receiving a request for a workstation assessment, the supplier is required to confirm the
appointment with the appropriate staff member/manager within 48 hours.
• On immediate completion of the workstation assessment, the supplier will provide self-help
resources to the appropriate staff member and provide the workstation assessment report to
the appropriate manager within 5 days. Recommendations wil be appropriately documented
including, when necessary, a work history and concerns raised, any environmental
adjustments made, advice provided or equipment recommended.

• The supplier wil be able to support work from home arrangements through checklist, remote
visual communications aid (e.g. photograph, video) and home visits.
• The supplier will facilitate quarterly meetings and interim e-mail updates with MBIE to inform

Occupational Health Nursing or an equally qualified professional to undertake assessments.

early pain or discomfort conditions through appropriate health care pathways.
- The ability to provide electronic resources to workers as MBIE moves towards a paperless
environment.

SECTION 3: Our Evaluation Approach
This section sets out the Evaluation Approach
that will be used to assess Quotes.
3.1 Evaluation model
The evaluation model that will be used is weighted criteria (all criteria are of equal importance). Price
is a weighted criterion. This means that Quotes that are capable of full delivery on time may be
shortlisted. The Quote that scores the highest will likely be selected as the Successful Respondent.
A ‘two envelope’ system wil be used for the evaluation. This means that Respondents must provide al

financial information relating to price, expenses and costs in a separate sealed envelope/soft copy
folder. The evaluation panel will firstly score each Quote based on the weighted criteria listed below.
Quotes will then be ranked according to their scores. Following completion of the scoring the sealed
envelopes containing financial information will be presented to the panel. The panel will then assess
which Quotes to shortlist based on best value-for-money over the whole-of-life of the Contract i.e. the
scores and the total costs over the whole-of-life of the Contract.
3.2 Pre-conditions
Each Quote must meet al of these pre-conditions. Quotes which fail to meet one or more will be
eliminated from further consideration.

3.5 Price

SECTION 5: Our Proposed Contract
5.1 Proposed Contract
The Proposed Contract that we intend to use for the purchase and delivery of the Requirements is
the Employee Health Management Services Statement of Work; this is attached as a separate
document.

The Statement of Work will include any necessary additional terms in line with the requirements
outlined in Section 2.
In submitting your Quote you must let us know if you wish to question and/or negotiate any of the
terms or conditions in the Proposed Contract, or wish to negotiate new terms and/or conditions. The

wil be deemed to have accepted the terms and conditions in the Proposed Contract in ful .
