Thank you for your email of 27 November 2024 to the Ministry of Business, Innovation and Employment
(MBIE) requesting, under the Official Information Act 1982 (the Act), the fol owing:
I would like all current, standing information about LSPs and participating agencies’ obligations
under the LAS programme, as set out under the Lead Agency Agreements and Participating
Agency Agreements.
I have read what has been specified in the opt-in policy, but would like to know what the
contractual obligations are, particularly in terms of the use of qualified interpreters, interpreters'
working conditions and interpreters' rates (both for face to face and for video and telephone
interpreting).
On 12 December 2024, we asked you whether you could refine your request given the breadth of
scope of the contractual obligations, but we did not receive a response.
On 9 January 2025, we advised you that MBIE decided to extend the period of time available to make
a decision on your request under section 15A(b) of the Act, as consultations necessary to make a
decision on your request meant that a proper response to the request could not reasonably be made
within the original time limit.
Our Response
I have enclosed the fol owing documents:
• the Lead Agency Agreement and Participating Agency Agreement for Face-to-face interpreting.
The generic agreement applying to all Language Service Providers on the panel has been
provided. This has been varied to extend the expiry date for three years until 31 August 2027.
• the Lead Agency Agreement and the Participating Agency Agreement with Comms Australia Pty
Ltd for telephone and video interpreting. This was novated from Intellicomms Pty Ltd to Comms
Australia Pty Ltd (following Intellicomms’ liquidation). The novated agreement has been varied
to extend the expiry date until 31 March 2025.
The information has been supplied with information out of scope removed and some information
withheld under the fol owing section of the Act:

• 9(2)(b)(ii) to protect information where the making available of the information would be likely
unreasonably to prejudice the commercial position of the person who supplied or who is the
subject of the information.
I do not consider that the withholding of this information is outweighed by public interest considerations
in making the information available.
