Request under the Official Information Act 1982
Thank you for your email of 9 December 2024, requesting information from Whitireia and WelTec ǀ
Te Pūkenga – New Zealand Institute of Skil s and Technology (Whitireia and WelTec).
In reply to our letter of response dated 9 December 2024, to your previous OIA request dated 14
November 2024 (reference TP240141), you asked:
In that case, please provide information on the rate of sexual violence on campus, across the last
three years al -inclusive. If you don't have this information, why not?
This letter provides a formal decision on your request under the Official Information Act 1982 (OIA).
Interpretation of sexual violence definition
In order to assist us with a definition of “
sexual violence”, to enable our search for any information
within scope of your request, we referred to Te Kāhui Tika Tangata Human Rights Commission
guidelines.
Our determination of what fal s within scope of your request in relation to “
sexual violence” was
therefore supported with reference to the guidelines section titled “
What is sexual harassment?”,
which can be viewed at
: https://tikatangata.org.nz/resources-and-support/guidelines/sexual.
Our search parameters for your request included complaints registered between 9 December 2021
and 9 December 2024, that included keyword “
sexual” within the complaint topic.
The decision
Within the time period above, <4 ākonga (student) and/or kaimahi (staff) complaints have been
received at Whitireia and WelTec that make reference to the term “
sexual” within the nature of the
complaint, and therefore we have determined fall within scope of your request.

Providing the exact number of such complaints for this time period would yield a result of less than
four. Therefore, to protect the privacy of natural persons, we have withheld the exact number with
reliance on section 9(2)(a) of the OIA. We do not believe the need to withhold this information is
outweighed by the public interest in its release.
You have the right to make a complaint to the Ombudsman under section 28(3) of the OIA if you are
not happy with this response. Information about how to do this is available at
www.ombudsman.parliament.nz or by cal ing 0800 802 602.
We may publish our OIA responses and the information contained in our reply to you on our website.
Before publishing we will remove any personal or identifiable information.
Ngā mihi
