“The audit reports you link to,
doesn't provide any independent assessment either that HDC is achieving its legislated
goal nor that its approach is aligned with best practice. Please clarify whether this has ever
occurred, and if so, please provide a copy of the report from that assessment.”
We have considered your request under the Official Information Act 1982.
There has been no specific independent assessment conducted on how the Office of the
Health and Disability Commissioner achieves its legislative goals or aligns with best
practice. Therefore, we refuse your request pursuant to section 18(e) of the Official
Information Act, as the document alleged to contain the information requested does not
exist, or, despite reasonable efforts to locate it, cannot be found.
HDC’s performance in respect to these matters is reported in annual financial audits, our
annual reports, and the Statement of Performance Expectations. The Statement of
Performance Expectations sets out the annual performance targets for HDC and the
activities we will undertake to achieve them. This information can be found on our website
here.
HDC’s performance in relation to legislative goals and how we align with best practice is
also examined by Parliament in the Health Committee’s Annual Review of the Health and
Disability Commissioner. You can find the questions the Health Committee asked our
office, HDC’s responses to these questions, and the Final Reports of the Health Committee

n Parliament’s website. The Ministry of Health also monitors HDC’s performance.
You may seek a review of this decision from the Office of the Ombudsman or the Privacy
Commissioner.
