Thank you for your request of 9 October 2024 to the Ministry of Business, Innovation and Employment
(MBIE) requesting information under the Official Information Act 1982 (the Act).
For ease of reference questions 2 and 3 have been answered together with other questions responded to
in turn.
1.
The number of bids received for tender number 48182 to provide legal services for NZCRS.
There are seven tenders in total, but one withdrew themselves before MBIE considered them.
2. The contents of any proposals submitted.
3. A copy of the current contract (including any amendments) and the previous seven years'
contracts between Community Law Centres o Aotearoa Inc and NZCRS/GCCRS.
Please find attached the Request for Proposal (RFP) submitted by Community Law o Aotearoa, as well as
a copy of the current contract between MBIE and Community Law o Aotearoa.
RFPs submitted by the other tenders are being withheld in full under section 9(2)(ba)(i) of the Act, to
protect information which is subject to an obligation of confidence or which any person has been or could
be compelled to provide under the authority of any enactment, where the making available of the
information would be likely to prejudice the supply of similar information, or information from the same
source, and it is in the public interest that such information should continue to be supplied.
I am also refusing your request for the previous contracts over the last seven years under 18(e) of the Act,
as the documents alleged to contain the information requested do not exist.
Please note some information within the provided documents have been withheld under the following
sections of the Act:
• 9(2)(a), to protect the privacy of natural persons, including that of deceased natural persons;
• 9(2)(b)(ii), to protect information where the making available of the information would be likely
unreasonably to prejudice the commercial position of the person who supplied or who is the
subject of the information;
• 9(2)(ba)(i), to protect information which is subject to an obligation of confidence or which any
person has been or could be compelled to provide under the authority of any enactment, where
the making available of the information would be likely to prejudice the supply of similar
information, or information from the same source, and it is in the public interest that such
information should continue to be supplied.

Information on any audits undertaken by NZCRS or MBIE in relation to services being provided
under the current and previous contracts.
MBIE do not have an audit function over Community Law other than their monthly reporting. Therefore, I
am refusing this request under 18(e) of the Act, as the document alleged to contain the information
requested does not exist.
In terms of section 9(1) of the Act, I do not consider that the withholding of this information is
outweighed by public interest considerations in making the information available.
