Dear Erika

Thank you for your Official Information Act request received on 7 October 2024. You requested:


How many fines were issued of up to $1000 by Worksafe

How many heavier penalties were issued by Worksafe?

Of these fines, how many were successfully col ected by Worksafe?

How many have gone off to the MoJ to be col ected?

We have assumed that you are particularly interested in infringements relating to workers in the
health and disability sector, on the basis that the guidance document you referred to was produced
by the Ministry of Health for that sector.

Please note WorkSafe considers the information in that guidance document to be inaccurate, as
WorkSafe did not have the power to issue Infringements to PCBUs in the amount of $1000 for
each unvaccinated worker.

WorkSafe did not issue any COVID infringement notices to Persons Conducting a Business or
Undertaking (PCBUs) in the health and disability sector.

WorkSafe did issue nine COVID vaccination infringement notices between December 2021 and
March 2022. These notices related to the retail, hospitality and fitness sectors. None of these
notices involved any collection of fines. WorkSafe likewise did not issue any heavier penalties for
unvaccinated workers, as it is the Court that holds that power.

I am also informed that no fines were referred to the Ministry of Justice to be collected.

This reply addresses the information you requested. You have the right to ask the Ombudsman to
investigate and review my decision, and further information is available at
www.ombudsman.parliament.nz.

If you require further assistance, please contact [email address].

Yours sincerely
