Re: Fluoridation of drinking water 
 
 
Thank you for your email of 29 August 2024 for information about the dates legal advice 
was sought and received in relation to specific issues concerning the Health Act 1956 and 
the fluoridation of water. 
 
A review has been conducted of Council legal advice in relation to fluoridation, and we can 
confirm that Council received legal advice on issues in relation to fluoridation on 30 June 
2020 and 21 November 2022. However, the advice was not in relation to the specific issues 
set out in your email. The Council does not waive legal professional privilege. 
    
The decision by Auckland Council to release the information contained in this response was 
made by Arman Askarany, Legal Counsel.  
 
Should you believe Auckland Council has not responded appropriately to your request, you 
have the right by way of complaint, under section 27(3) of the LGOIMA, to apply to the 
Ombudsman to seek an investigation and review of the decision.
