Thank you for your request of 18 August 2024, to Fire and Emergency New Zealand seeking
information relating to MRCagney and the “
Traffic calming and effective response speeds” report
(the report) under the Official Information Act 1982 (OIA). We copy and respond to each aspect of
your request below. Please note, we rearranged the order for ease of response.
1. Which conflicts of interest did MRCagney, or any one from MRCagney, declare to FENZ
related to producing the 2022-2023 ‘Traffic Calming and effective response speeds’ report?
MRCagney did not declare any conflicts of interest in relation to their producing the report.
2. Does FENZ have any record that MRCagney was involved in writing Auckland Transport’s
‘Street and Road Design Guide’ and/or Auckland Transport’s ‘Urban Street and Road Design
Guide’?
3. Does FENZ have any record that MRCagney was involved in writing Auckland Transport’s
2017 ‘Local Path Design Guide’?
We did not identify any records that show Fire and Emergency personnel becoming aware of items
identified in these questions. Please note that we only checked our records relating to our
engagement with MRCagney over the production of the report.
4. When did FENZ become aware that MRCagney had been promoting the installation of
raised platforms, raised crossing, and/or wombat crossings in New Zealand and/or
Australia
5. When did anyone at MRCagney inform FENZ (by document or email) about the 2000 report
from the US titled ‘Emergency Response, Traffic Calming and Traditional Neighborhood
Streets’?
We did not identify any records that show Fire and Emergency personnel becoming aware of items
identified in these questions. Therefore, we are refusing your request for the time in which Fire
and Emergency became aware of them under section 18(e) of OIA, as the document al eged to
contain the information requested does not exist or, despite reasonable efforts to locate it, cannot
be found. As above, we only checked the records relating our engagement with MRCagney over
the production of the report.
6. How much was paid to MRCagney for the 2022-2023 ‘Traffic Calming and effective
response speeds’ report?
$60,000 (excluding GST) was the final amount paid to MRCagney.
7. Can you release the contract and scope-of-work documents between FENZ and MRCagney
which relate to the 2022-2023 ‘Traffic Calming and effective response speeds’ report?
Please find attached, as the
Appendix to this response, the contract and scope of work documents
between Fire and Emergency and MRCagney which relate to the “
Traffic calming and effective
response speeds” report. Some information has been withheld pursuant to:
• section 9(2)(a) of the OIA, to protect the privacy of natural persons; and
• section 9(2)(b)(ii) of the OIA, to protect information where the making available of the
information would be likely unreasonably to prejudice the commercial position of the
person who supplied or who is the subject of the information.
In making this decision, we have considered the public interest considerations in section 9(1) of the
OIA.
