Thank you for your response email to me dated 29 August 2024 to Te Kaunihera o Pōneke |
Wellington City Council (the Council) requesting information. After refinement and clarification, you
have requested the fol owing information:
Please provide any complaints by Cr Calvert to the Chief Executive and/or senior managers,
(including any correspondence and complaint outcomes with Cr Calvert), in relation to staff
advice/conduct on the Long Term Plan and/or the Thorndon Quay roading changes for the period
between 1 May and 7 August 2024.
Your request has been considered under the Local Government Of icial Information and Meetings Act
1987 (LGOIMA) and the decision to refuse information in scope of your request has been made under
the following sections of the Act:
• Section 7(2)(c) as the withholding of information is necessary to protect information, which is
subject to an obligation of confidence, and the making available of the information would be
likely to prejudice the supply of similar information, or information from the same source, and
it is in the public interest that such information should continue to be supplied.
• 7(2)(a) - the withholding of the information is necessary to protect the privacy of individuals, in
this instance a private employment matter.
Please also include any health and safety reporting relating to Cr Calvert by staff for the period
between 1 May and 7 August 2024.
With respect to this part of your request relating to any health and safety reporting, this part of your
request has been refused under section 17(e) of the Act, as on investigation the requested document
does not exist.
As per section 7(1) of the LGOIMA, I do not consider that in the circumstances of this response, the
withholding of this information is outweighed by the other considerations which render it desirable to
in the public interest to make the information available.
You have the right, by way of complaint under section 28(1) of the LGOIMA, to request an
investigation and review of the Council’s decision to withhold information by the Ombudsman.
