Request made under the Official Information Act 1982
Thank you for your email
of 7 August 2024 requesting information under the Official Information Act
1982 (the Act) regarding music used on the Drive website. In particular, the music used in the
"Preparing for the New Zealand restricted licence test" video.
I will respond to each of your questions in turn below.
(1) The title and the artist of the track
The title of the track is ‘Drive intro/outro’.
Details regarding the track’s artist has been withheld under section 9(2)(a) of the Act to protect the
privacy of natural persons.
(2) Who Waka Kotahi New Zealand Transport Agency obtained the track from
NZ Transport Agency Waka Kotahi (NZTA) and Accident Compensation Corporation (ACC) worked
with the agency
Strategy Creative to deliver the music as part of a broader project to develop a series
of videos for the
Drive programme.
NZTA and ACC are partner organisations in the Drive programme. Ownership of the track and all
intel ectual property rights contained are jointly owned by both agencies.
(3) A high quality audio file of the ful length track
(4) High quality audio files of any alternate - i.e. shortened - versions of the track
Neither NZTA nor ACC hold a high-quality audio file of the full length or the shortened length of the
track. As such I am refusing your request under section 18(g)(i) as the information requested is not
held by us and I have no grounds for believing the information is held by another government
department.
(5) If Waka Kotahi New Zealand Transport Agency is unable to provide a full length audio file or
details about the track, further information on how a member of the public could obtain this
information
If you are wanting to use the track for personal and non-commercial purposes, this can be taken
directly from the video file that is already located in the public domain.
If you are wanting to use the track for commercial reasons, under the terms and conditions for all Drive
content, you wil need to first gain permission from NZTA and ACC. To do so, you wil need to outline
the reasons for the request and the purpose for which you intend to use the track. This information can
