Thank you for your email of 29 July 2024 to the Ministry of Justice (the Ministry), requesting,
under the Official Information Act 1982 (the Act), documents regarding Te Au Reka.
Specifical y, you requested:
Please provide copies of tender responses to the Te Au Reka Digital Digital Courts
Case Management System tender.
The requested tender responses contain commercial y sensitive information that includes
pricing models, detailed information about each respondent’s proposed technology and other
intel ectual property, processes, procedures and methodologies. I am therefore withholding
these documents in ful under section 9(2)(b)(i ) and 9(2)(ba) of the Act, as their release
would likely unreasonably prejudice the commercial position of the respondents and
prejudice the supply of similar information in future.
In addition, as the Ministry is stil in negotiations with one of the respondents prior to
awarding the implementation contract, the tender process is not yet ful y complete, so I am
therefore withholding the responses under section 9(2)(j) of the Act, to enable the Ministry to
continue those negotiations without prejudice or disadvantage.
In withholding this information under section 9 of the Act I have considered the public
interest and do not consider it outweighs the need to withhold the information sought at this
time.
Once the negotiations for the implementation contract are complete, the Ministry wil publish
details of the award of the contract on the Government Electronic Tender Site (GETS).
