Official Information Act request
Thank you for your email dated 8 May 2025 to the Ministry of Justice (the Ministry),
requesting further information under the Official Information Act 1982 (the Act), about the
alleged release of COVID-19 vaccine data by a former Health New Zealand - Te Whatu Ora
employee. Your request follows the Ministry’s response dated 20 December 2024 on the
same topic (ref: OIA 115957). Specifically, you requested:
As a follow up and requesting no personal data - please provide the...total number of
coronial cases that were impacted by the data / payouts made.
In response to your request, the exact number of impacted Coroners Court cases is court
information. Under section 2(6)(a) of the Act, courts are not subject to the Act so I am
refusing this part of your request under section 18(g)(i) of the Act, as the information
requested is not held by the Ministry and I have no grounds for believing it is held by another
agency or Minister.
In response to your request regarding payouts, the Coroners Act 2006 provides no
legislative ability for coroners to make or direct payouts. As noted in our previous response,
the Ministry had very limited involvement in this matter and did not make any payouts. I am
therefore refusing this part of your request under section 18(e) of the Act because the
information you requested does not exist.
